**John August:** Hello and welcome. My name is John August.

**Craig Mazin:** And my name is A Very Christmas Craig Mazin.

**John:** This is our Christmas episode of Scriptnotes, a podcast about screenwriting and things that are interesting to screenwriters.

Now, Craig, we’re recording this a few days early so we’re not literally just sitting by the tree. There’s probably no eggnog in our hands. Maybe you have eggnog, I don’t know.

**Craig:** No. I think eggnog is gross.

**John:** I love eggnog…

**Craig:** Ew!

**John:** We might have to have a big fight about this. Eggnog is amazing. It’s essentially just melted ice cream that you get to drink out of a cup. And it’s just the best.

**Craig:** It’s melted ice cream with weird spice in it.

**John:** What is weird about nutmeg? Nutmeg is one of the most wonderful spices if used in moderation.

**Craig:** You know what it is? It’s the word “egg” and the word “nog” are so gross. Plus you have those two Gs, eggnog. It sounds like something that Orcs would say, and I don’t like it.

**John:** Yeah. It has a very Germanic quality to it, but I have always loved eggnog to the degree that I remember once I came back from, like, a summer scouts meeting and it was, like, a hot day in August —

**Craig:** Oh god!

**John:** — And I was like, “Mom, I really want some eggnog.” And my mother, who is so generous, was just like, “Okay, I’ll make you some eggnog.” So, she literally made — like the skim milk in the fridge, and some eggs, and some sugar, and some vanilla, and some nutmeg, and she made in a blender some eggnog. And that’s why I love my mom.

**Craig:** You know, my grandmother used to tell the story about how when she was a child on a really, really hot day back in Russia she would drink iced cold buttermilk. [laughs] And, you know, that sounds pretty good because it’s butter, and it’s milk, and everybody loves butter, and everybody loves milk. But buttermilk is just rotten milk.

**John:** I would disagree. I would say buttermilk is soured milk. And it has a certain quality to it that makes it fantastic for biscuits, or for ice cream. Buttermilk ice cream.

**Craig:** You mean rotten quality? [laughs]

**John:** I think it’s delicious. But everyone has their own tastes. For example, do you like crème fraîche? Is that a taste you like?

**Craig:** It’s funny that you mention that because I was explaining to our video playback guy last week that I actually have a weird thing about white food in general. And crème fraîche is a great example of white food I do not eat. There’s something about white sauce type food — mayonnaise, crème fraîche, tartar sauce, there’s more I’m sure. Tahini. Even that’s something — I just can’t do it. I can’t go near it.

**John:** Yeah. There’s a puss-like quality to it that might turn some people off. Cottage cheese, I’m sure, falls into that.

**Craig:** No. I can do cottage cheese if I mix it with fruit.

**John:** That makes no sense at all, Craig.

**Craig:** If I mix it with fruit. That one is an exception. And I can do like certain yogurts and stuff like that. But there’s a lot of white food that just horrifies me. Mayonnaise is my number one, but crème fraîche, sour cream, because that’s what crème fraîche is, right? Isn’t it sour cream? Which is a lie…

**John:** It’s a special kind of sour cream, yeah. You’re just a food racist and we should probably move onto another topic.

**Craig:** Yeah. I don’t like white food.

**John:** So, you’re making a list at Christmastime. There is a famous person who makes a list around Christmastime, well, Santa, but even more important than Santa, Franklin Leonard makes a list around Christmastime.

**Craig:** Yes. Dreadlock Santa makes a list.

**John:** And Dreadlock Santa this year made a list called the Black List, as he does every year, in which he surveys the development executives to ask them what their most liked scripts are. He always wants to make it clear that this isn’t the “best of” list; it’s like the most liked screenplays that people have read this year.

And so that came out this last week, or actually two weeks ago for people who are listening on Christmas day. And there were a lot of great titles there. Some people that we know, mutual friends. Eric Heisserer, Story of Your Life, was one of the highly liked scripts.

**Craig:** Great to see.

**John:** Jonathan Stokes, who is one of my WGA advisees, his script Border Country was listed there.

**Craig:** Oh! Awesome. Yeah, good for him.

**John:** And a person who wrote into our site for the Three Page Challenge, Austin Reynolds, his script, From New York to Florida, was also on the Black List.

**Craig:** What script did he send in for us?

**John:** So, the three pages I think we read was something that you liked much more than I liked in the first three pages, where there’s a kid in class who is scribbling…

**Craig:** Oh, I remember that guy, yeah.

**John:** So, you apparently have great taste.

**Craig:** Well, see that? God, I know what I’m doing.

**John:** Yeah. So, maybe we’ll go back through and re-edit that so we sound really knowledgeable and that we should single that out as being highly praise-worthy. But congratulations to Austin Reynolds; that’s fantastic. I’m happy that these people had good outcomes.

**Craig:** Yeah.

**John:** As I was looking through the list, one of the things I was trying to look for — patterns — in addition to, like, names I recognize was: what are people writing about, and what are these spec scripts that people are working on? And one that really stuck out was by a writer named Young Il Kim called Rodham. And it’s the story of Hillary Rodham Clinton’s rise as a young lawyer, sort of rising in politics, and she falls in love with this guy Bill Clinton.

And I was like, that was a great idea for a spec. I have no idea — obviously the spec is pretty good because people like it, but people want to know like, “Oh, what kind of spec should I write?” That seems like a great idea for a spec. That’s public domain. It’s interesting. People are going to want to read that. Good choice. Good subject material.

**Craig:** Yeah. It is a good choice. And it’s accessible. And people can actually compare what you’ve written to their understanding of reality and see in evidence the drama that you have created. It’s a very smart way of approaching it.

**John:** So, today I thought we’d talk through some of our mail bag questions, but one of them was actually really relevant to what we’re doing right now which is an email we got from Brantley Aufill. And so it’s kind of long but I’ll read it because it’s nice. It’s happy. And so it’s a good thing for this time of year.

**Craig:** Great.

**John:** Brantley writes, “In September of 2011, I sent you an email about something you said on the podcast. Well, it’s like, ‘I mostly want to write period detective stories with monsters.'” I kind of remember saying that. So, talking about, like, what genre is your genre.

Brantley writes, “I remarked that I had just done exactly that having written a spec called The Hooverville Dead which found me my manager just a few months prior. Over the following months, I listen to Scriptnotes every week, and so many times it seems to be recorded just for me, as I was writing and rewriting, as the script started going out, as I began to get generals, as I began to do pitches, as I signed with my agents, as I tried to think over what to write next.

“The topics you and Craig were covering often coincided exactly with where I was navigating this crazy world as a new screenwriter. Flash forward to today. The Hooverville Dead has become my calling card and just made this year’s Black List.”

**Craig:** Great.

**John:** “I’m still doing generals. I have yet to make that first writer’s paycheck, but I have quite a few projects in ‘this might be the one’ column. I’m taking my next spec to a major studio with a producer already attached. I developed a TV show with a producer that we’re talking to networks about next month. I have different pitches at different studios, four of which I set up over a 26-hour period later this week.

“So, I’m reading book after book, writing up treatments, and pitching my take, and I’m on people’s minds as they think of a writer they want to work with. And I’ve been loving just about every minute of it. So, thanks to you and Craig for Scriptnotes; the last few months have been a bit of a whirlwind but I like to think the advice you two have been providing has helped me keep up just a little bit ahead of it. Thanks, Brantley Aufill.”

**Craig:** Wow. You know what? Thank you man. That’s really nice of you. I’m glad that you are obviously doing well, you know. I mean, the fact that you haven’t gotten that first writer’s paycheck is a quirk of the timeline. It sounds like you will be soon enough. And, you know, as we’ve been doing this and you and I interact more and more with people who are aspiring, and particularly people who are right on that bubble where it seems like all the pieces are in place, and people are noticing their writing and they actually have the facility to do this, they just haven’t quite gotten that first purchase yet.

What’s been salient to me more than anything is attitude. And it’s the people with the great attitude who strike me as the most likely to succeed. And that’s a terrific attitude to have. The attitude of the student, and it’s one that I think you and I both maintain to this very day.

So, good for you. I’m glad that we’ve been of help to you.

**John:** Yeah. I would also say in terms of attitude: acknowledging good fortune, and success, and people who have helped you along the way. Because so much of this business, and sort of getting started in any business, are going to be the frustrations and all the things that go wrong. But when things do go right, when someone helps you out with something, it’s great to acknowledge that. And the people who help you out along the way, just take a moment to thank them for that.

So, thank you for writing in.

**Craig:** It’s certainly no sign of weakness. We all need help desperately. I remember Scott Frank years ago saying to me, “I need more help than any writer I’ve ever met. When I’m figuring out who I should work with on something — producer, studio executive, agent, whomever — it’s entirely about who will satisfy my deep need for help.”

So, you’re dead on with that.

**John:** Cool. Let’s continue that thread with some other questions that people have written in with and maybe we can answer a few more things for other people and get them started on their way.

**Craig:** Cool.

**John:** So, this first one comes — a writer who had written into the site and it was in the backlog of questions, and then he reached out to you on Twitter. And so you flagged it and so now we’re following up.

It’s a guy named Christopher in London who writes, “Having written my first feature screenplay a year after moving to London I began to get as many people to read it as possible. By your normal chain of events — basically, through my girlfriend — the script found its way to a producer who had made one other feature, and a few shorts.

“He loved the script and wanted to make it, so we began a second draft with the promise that after typing the script he would send it to potential ‘financiers, directors, and cast.’ Fast forward two and a half years, after draft number 13 he still hasn’t shown the script to another soul. In the meantime, I’ve shopped the script out myself, and now that I’ve secured an actual production company interested in making the movie I want to move on from this producer.

“Now, after asking him to sign an agreement to state that the rights to this script reside with me, he has said he won’t sign it and is suggesting he has some claim to my script. What do I do?”

**Craig:** Okay. Well, he does not have a claim to your script. Legally speaking, in terms of copyright, you are the author of your script. You have written every word. He has not created any unique expression in fixed form. What he’s done is act as an editor, and just as editors in the book world don’t have copyright claims on Stephen King’s novels, nor does this person have a copyright claim on your screenplay.

What this person may have a claim for is the right to be associated as a producer with this film. That claim is not something that’s adjudicated against you. That is something that they would have to deal with with a new producer that comes onboard. And, frankly, it’s kind of not your problem to the extent that it’s not specifically your problem.

However, when you’re talking to these new people you have to say, “Look, here’s this person. I don’t want them to be involved. They didn’t write anything. They’ve been acting as a ‘producer.’ They’ve been nothing but a hindrance, frankly. You should be aware that they’re there and so that’s something you guys have to work out.” And most likely the actual producers, the new financing entity would reach out to this “producer” and say, “We want to settle you out.” Or, “We want to exchange this guarantee of an onscreen producing credit for your release of the material and disappearing.”

There are all sorts of ways to make people go away. But, the two prominent ways are money and credit.

**John:** Yeah.

**Craig:** That said, it’s hard for these people to actually claim anything, because when push comes to shove they don’t have a contract with you beyond a verbal and implied contract. And so it’s one of those deals where that would have to be hashed out if it actually got to a lawsuit. You want to avoid lawsuits.

So, my recommendation here is that you, in conjunction with your attorney and the new producer, go instruct them to handle this person and make them go away as need be.

**John:** I agree. I would also say just take a step back and imagine that the other person was writing this question. And he would probably phrase his question to us this way: “So, I’ve spent the last two and half years working with this writer, reading every draft, giving notes on every step. Today he shows up at my door saying that he wants me to sign this release that I have no involvement with the project whatsoever. What do I do? I feel like this kid is being incredibly ungracious for all the hours, and hours, and hours of work I’ve put in on this script. What do I do?”

And it’s easy to see his perspective on this, too. I would say he hasn’t done a terrific job of all the other things of producing. Maybe he actually gave you good notes? Maybe he really did help you get the script into good shape, but he hasn’t been able to sort of move the project forward. So, I don’t blame you for wanting to move forward on your own. But, you are going to need to figure out some way to have him taken care of in this process because it does sound like he was involved for quite a long time.

Where it gets really frustrating for me is when, like, literally something kind of passed over a person’s desk and they’re claiming producer credit on it.

**Craig:** Right.

**John:** And that happens far too often and it’s really maddening. And especially newer writers can find themselves in frustrating situations with that. And I wish I had a magic wand to sort of make that all go away and be better, but it does happen.

And there’s people whose names are on lots of movies who are just really stubborn and they get their names on movies, even if they weren’t involved in the actual making of the film.

**Craig:** This is certainly not something that’s unique to our business, although you see it all the time. Very annoying people often are rewarded for being annoying. And this may be one of those cases. I would point out — he’s in London and I’m not quite sure what the differences are because, you know, here in the United States we have work for hire. Frequently what you’ll see is an option agreement between a producer and a writer which does contractually codify the relationship and grant the producer certain exclusive rights to represent the screenplay as the producer.

That may not be the case in England, but if it is the absence of that agreement speaks volumes.

**John:** Yeah.

**Craig:** So, this is really where you would need to speak to a lawyer, or a barrister, as the case may be.

**John:** Find somebody with a nice white wig who seems to know something about the law.

**Craig:** Yes. Yes. Go speak to Rumpole of the Bailey.

But, I think the fact that you’re dealing already with the financing entity — they have their own attorneys. They should be able to handle this. This is one of those areas — I look for these all the time. This is something to always keep your eyes open for: Moments where your goals and your needs align with those of other people. And then use them, [laughs], so basically draft behind them. It is in their best interest to get rid of this guy, therefore you should line up with them and allow them to do it for you.

**John:** And it may only be a series of phone calls between these people that it just gets taken care of. And if this guy doesn’t have a lot of other credits then that may be the case.

Our next question comes from Will in Seattle who writes, “On your most recent podcast you and Craig were expressing disdain at the lack of description in some of the Three Page Challenge scripts, specifically the use of ‘INT. OFFICE — DAY.’

“Your criticism came from not knowing what kind of office we’re in. However, in some of the most professionals scripts I’ve read, like Sideways or Up in the Air, the respective writers had a very minimalist style and often do little to describe in more detail the settings. Is it simply your assumption that we’re not Alexander Payne or Jason Reitman? Does the fact that they’re already industry professionals give them license to leave out the little things?”

**Craig:** I think in those cases the fact that they’re directing the movie gives them the license to leave out those little things. And this is something that I brought up on the DoneDealPro board.

There’s a backwards thinking among a lot of new screenwriters that only if you are directing the movie are you allowed to be specific about camera motion, camera action, and be very specific about things that would theoretically fall under the purview of the director, like, you know, perfecting the location and so forth.

And in my mind it’s the opposite. When Alexander Payne and Jim Taylor write a movie together, they can write “INT. OFFICE” because they’ve already discussed what the office looks like. No one is coming in to rewrite them. And Alexander is going to go out and scout for the office he wants and he’s going to tell people the office he wants, so he can save some space and time on the page. He’s quite likely not writing the script to do anything other than service him as he makes the movie. Similarly for Jason Reitman.

But if you are a writing the screenplay to attract a director, and to attract financing, it is critical to me that you use your one and often only chance to express the entirety of your dramatic intention for what this film should be, look like, sound like, and ultimately how this film will impact the audience.

**John:** Yeah. I don’t want to tell Alexander Payne and Jason Reitman how to write, and they can use their minimalist INT. OFFICE — DAY; if that works for them, that’s awesome, great.

But I’ll say that even if you’re the director, throwing just the tiniest bit of description to that — sort of like, is it a strip mall office, is it a corporate glass monstrosity office — it does help. And it helps everybody else who needs to read the script to get a sense of what kind of world that you’re pitching this story for. So, everyone else who needs to read the script to sort of do their jobs would be a little bit serviced by having a little more description there.

Again, totally your choice and what you want to do.

**Craig:** Yeah. That’s how — Todd and I, I mean, no one is coming in to rewrite us. We’re writing a screenplay for him to direct, we still do that stuff. I mean, for that very reason: we want the army of people that are going to be working on the movie to have that many fewer questions.

**John:** When you’re first sitting down with the location manager, he or she is pulling out a bunch of folders, and he’s showing you things that are probably closer to what your vision is of the thing so they don’t have to first ask you, “Describe this office to me; what should I be looking for?” I think in that first meeting they’ll have some sense of what you might be looking for and what might be appropriate. That’s why you give that kind of stuff.

**Craig:** Yeah.

**John:** Chris from San Francisco Bay Area writes, “I’m trying to find a musical script writer. What is this person even called? A book writer? Scriptwriter? Probably not a screenwriter. Are there resources, networks, or hangouts where these people exist? I’m looking for both options of partnering or hiring somebody to write the book or reviewing books that people have already written.”

So, sort of in my wheel house here. “Book writer” is usually what you call the person who is writing all the stuff that happens in a musical, a stage musical, the stuff that isn’t sung. So, the book is all that stuff. So, for Big Fish I’m the book writer.

Stuff that happens for Broadway tends to be centered around New York. Dramatists Guild is the organization that sort of loosely represents the interests of people who write for the stage. It’s not a guild the way that the Writers Guild is a guild. It’s a looser sort of association. Doesn’t have like collective bargaining power.

The Dramatists Guild is where you probably first want to check out because their house magazine is actually really good and has good interviews with book writers, and musical writers, and playwrights who are working on all this stuff, and will get you started there.

In terms of reading books, you can find published versions of some of the musicals you would want to see. And that’s going to get you started. There’s not the same kind of script libraries that you’ll find for screenplays. But you’ll figure it out. And I figured it out. I didn’t have great firsthand examples to look at, but you sort of figure out like what gets said and sort of how it fits in with everything else.

**Craig:** Can you tell me what is the difference between a book writer and a dramaturge? Or is it dramaturgue?

**John:** I think you can probably say either one of those. And, again, I may be slightly wrong here, so if I speak incorrectly someone will write in and correct me. A dramaturge is a person who is responsible for working with the playwright, and eventually the director, on the dramatic engineering of a piece. And so if it’s an existing work it can be working with the director to figure out how to mine all of the goodness out of it. If it’s a new play, it’s someone who is working with the playwright to facilitate things.

So, it’s not a writer per se, but it’s in some ways like a creative producer I would say.

**Craig:** I see. Got it.

**John:** A person who’s helping out that way.

**Craig:** Got it. Okay, great.

**John:** Cool. Our next question comes from Hamish who writes, “In podcast 67 you and Craig talked about how hacky it is to establish a character’s backstory via magazine covers. The same day I read the shooting script of Frankenweenie and spotted the following…”

**Craig:** [laughs] I love it already.

**John:** “Burgemeister unfolds the newspaper to read the front page. INSERT NEWSPAPER: The headline reads MAYOR BURGERMEISTER TO KICK OFF DUTCH DAYS. A photo shows Mayor Burgemeister complete with sash and hat.”

**Craig:** That’s totally different.

**John:** “Burgemeister is pleased with the photo.”

**Craig:** That’s totally — how do you not see that that’s totally different?

**John:** I think it’s similar enough that it’s a valid criticism.

**Craig:** I don’t think so. Here’s the deal. The difference is expositing — am I allowed to say “expositing,” by the way?

**John:** Absolutely. Totally. It’s your podcast.

**Craig:** Yeah. I’m going to invent it if it’s not actually a word.

It is creating the exposition for an event or fact as opposed to creating exposition for a character’s essence or quality. That’s the difference to me. I don’t want — and I would presume this isn’t the opening of the movie of Halloweenie. [laughs] I’m going to call it that forever.

You know, when you’re meeting a character in the beginning of a movie it is super hacky to give us key bits of information on a magazine cover about them. It is all too common to use every day news delivery sources in a film to deliver actual news. That’s fine.

**John:** Yeah. So, I think sliding back towards the hacky column, it is in his first reveal. So, you’ve revealed that you actually haven’t seen Frankenweenie, but I’ll tell you that the paper arrives, you see that he’s meticulous with his lawn, he picks up the newspaper and we see his face in the photo and it’s also revealed that that is his face as well. So, it’s meant to be the joke that it’s exactly the same shot as we’re seeing is the photo that’s on there. But, it is hacky backstory in the sense of, like, that’s how we are establishing that he is the mayor.

**Craig:** Well, you know what I like though is that you took something that has the potential for hackiness and you put some spin on it so that there was more than just the information. You made a joke out of it.

**John:** Yeah. So, there’s a little bit of a spin. But I don’t want to run away from the criticism that it is a little bit hacky to do it. And I feel that in Frankenweenie the nature of our world and sort of how it all works, it’s less awful than it could be in other situations.

The truth behind why I did it in Frankenweenie is that there’s so few frames and minutes and seconds in that movie to get crucial information out, it was the only time that we were going to be able to establish that he was the mayor of the town.

**Craig:** Well, I’m going to stand in stronger defense of your work than you have here.

**John:** Thank you very much.

**Craig:** You’re welcome.

**John:** Mike in Los Angeles writes, “Let’s say hypothetically I have 12 weeks to write a script from idea to finished first draft, like my thesis script for example. How do you or Craig break down your work into daily goals to make sure you hit that deadline? I understand once I get into the writing that I can divide it out in a daily page count, but I’m more interested in how you do it prior to the writing. How are you breaking story, working with characters? How do you do it?”

**Craig:** Well, for me I am, because I outline very thoroughly, I am less concerned about how much time I’m taking during that process. I sort of feel like if I get that right then I look at what I’ve got left. Presumably it will be at least half of the remaining time. And the process of then dividing pages by 5 days a week to give myself a couple days off isn’t going to leave me with some crushing burden.

Sometimes I will sort of work backwards. I’ll say, “Okay, I have 12 weeks. I know I don’t like writing more than four pages a day. I feel like that hurts. That’s 20 pages a week. Presume that the screenplay is 120 pages and then I’ll narrow it down a bit, so we’re talking about six weeks. So, I have six weeks to break this outline out.”

And then I take a nice breath and I feel like I have lots of time, but I don’t do that so I’ll waste it — don’t waste any time. I start right away. And I begin — we talked about this before — everybody has different ways in. I like to begin with some big basics, the premise of the movie, a protagonist who is appropriate for that premise, a theme that is appropriate for that character and that premise, and instigating a beginning that is appropriate for that person, that matches to the end that is appropriate for that person.

And then sort of laying out the second act as a proven ground for that individual to go from where they are in the beginning to that very different character place at the end. And then what happens in between is writing. Even if you’re not actually writing, if you’re just doing cards or scene ideas or thoughts, that is truly where half of — 70%, 80% of what matters goes.

So, that’s my method.

**John:** In the question he’s saying, “from idea to finished draft,” but I honestly feel like the ideas phase can be a very long, amorphous period. So like for the ABC thing I just wrote, the idea phase was, you know, there was the idea, and then it was talking to Josh about it, and going to pitch it. And so by the time I was actually writing an outline everything was really, really fleshed out. So, at a certain point we had it up on the board and I had act breakouts and then I had to write up this outline. So, it’s really hard to say sort of when the clock started ticking on it.

But that was a case where TV — a lovely thing about TV is because there are act breaks I can say, like, “I’m going to write an act today,” and then it’s just done. And that was really simple and it’s very quick to write a TV script for those reasons. And actually the last acts are really short, so it goes even faster than that.

For a feature project I try to give myself daily page counts. Once the clock is really ticking and there are 12 weeks to turn this thing in, I will give myself daily page counts. And if I do set myself to five pages a day you get done really early. And so some days you won’t actually hit that, but other days you will hit that and it will all get finished.

What I will tend to do is a little carrot and a stick. And so I’ll make some deal with myself at the start of the week saying that if I write five pages every day then I get to buy myself something that I really want. And if I don’t actually hit those five pages a day then I don’t get that thing.

Other times I’ve had to sort of punish myself where if I don’t hit — any day that I don’t hit my pages I will have to make an anonymous donation to an organization that I despise.

**Craig:** Ha!

**John:** So, I try to sort of get the work done and feeling good, and feeling great, but sometimes it is just a matter of like cranking through the pages so you can get something finished.

**Craig:** Yeah.

**John:** Yeah. So, our last question is from Adam Pineless. Pineless, like a treeless mountain. He writes, “I’ve heard some films have 10 to 15 other writers come in and punch up a script. What’s up with that? What actually happens?”

So, punching up is a thing that happens largely on comedy scripts, before they go into production. Craig and I have both been part of comedy punch-ups. Are they a good thing, Craig?

**Craig:** I do think they’re good things. But it depends on what kind of punch up session you’re describing or punch up employment you’re describing. Very often on true comedies that are very joke driven, there will be one day where eight or nine comedy guys will be invited to sit in a room with the screenwriter, and the director, and the producer, and typically a studio representative, and you’ll go through the script.

Sometimes you go through the script and just talk about the script itself and kind of get the collective wisdom of people who have written comedy scripts before who can give you advice on character, plot, theme, things that don’t work, things that do work. And sometimes it’s literally just a page-by-page, “Any ideas for some jokes here?”

And we do this for each other. Typically the pay is somewhere between — it used to be $5,000. It has dwindled as low as $1,000 at times. Sometimes it’s $2,500. And we tend to do this for each other. I go to a lot of these things. And I have a little roster of people that I rely on when I want to do one for something I’ve written.

So, that’s fine. And I should point out that those writers are never eligible for credit. It is accepted from the credit process as not considered writing; it’s just “stuff” really. It’s just thinking, group thinking.

**John:** Yeah, because none of the writers in the room are actually writing anything down on paper. There is no literary material being created. There is just a discussion happening.

**Craig:** That’s exactly right. Sometimes I’m hired to punch up a script where I’m given a screenplay. It’s almost always very close to production. And I’m asked to go through and fix some dramatic things, fix some character things, and add some comedy here and there. And they usually give you a cheat sheet of where they believe the hot spots are and what they feel needs help. And this is typically done on a weekly basis, one week, or two weeks, sometimes three.

That is where movies can be greatly helped by the right person, but if the studio is chasing subsequent writers and there is a succession of people coming in and doing these things the script becomes a sort of flavorless mush. This is all separate and apart from a general parade of rewriting which can occur in development where people simply don’t know what the movie is supposed to be. It hasn’t been green lit yet and they just keep hiring writers to try different versions of the same idea.

And it’s quite rare that films like that work out well. There is one movie in particular I was asked to write, and I chose not to, and it had been around — this was a couple years ago — and it had been around and in development for so long that the friend of mine who had actually done work on it at one point, the draft that he did work on had the World Trade Center as a major plot point. [laughs]

So, it had been well over ten years in endless rewrite hell. And the movie that resulted was not a particularly good film. It’s just one of those things. At some point studios can’t stop chasing something and they should just stop. But, you know, these punch up groups, these occasional roundtables are actually quite useful, I think, and I always say if you get two really good jokes out of five hours of nine writers pitching jokes, it’s a victory. You got two great jokes.

**John:** I agree. So, the sessions that we’re describing, I hear them called “punch-ups,” I hear them called “roundtables.” Sometimes they’ll be preceded with a reading, so they’ll either bring in the real cast or just funny actors to read through things so everyone can hear it together and see sort of what’s working and also hear what’s not really working.

They mostly happen in comedy because that’s where a day’s work can actually achieve something. It’s finding some jokes. Because if you get two great jokes, and one of them makes it to the trailer, that was money really well spent and time really well spent.

**Craig:** Yeah.

**John:** So, that can be really gratifying. And just sometimes it’s not even like a brand new joke, but just like a slightly better version of a joke can help. A character saying a funny thing can be really useful.

So, I think they’re useful for comedies. You don’t see them very much in dramas. Craig’s point about a long parade of writers over the course of time, I worked on Tarzan which is at Warner Bros. So, recently they announced a new version that they’re trying to do at Warner Bros. And god bless them, you know, maybe there are 15 writers who’ve tried to do Tarzan there.

So, if that movie were to get made at a certain point I’m probably still on the chain of title for that, that long history going back, but I don’t know if a single thing I’ve written resembles what’s in Tarzan right now. And that’s an example of like, well, of course you’re going to keep trying to make that because that’s a great property, that’s a great brand. It’s just a really hard movie to make.

**Craig:** Yeah. And, you know, studios experience internal turnover as well. People who control the development of properties are fired, they’re hired. Producers lose their deals. They come and go. Things go in and out of style. There are movies that are written of a certain kind that are seen as outdated or out of step with what people want, and then suddenly another movie comes along that makes it instep and in line with what people want.

And so these things happen in fits and starts. Personally, if I were running a studio, and I looked down at my development slate and saw a few of these things that had been kind of lumbering along, soaking up development dollars year, after year, after year, I’d kill them. Or, I would hire a writer-director, or a writer-director team to develop it because ultimately the conventional process is just simply not working for this project.

**John:** Yeah. One of the projects — we may have both worked on this. Did you ever work on Scared Guys over at Sony?

**Craig:** I remember reading it at one point. I don’t think I — no.

**John:** So, it’s a project that was at Sony for — it probably still is at Sony, probably someone is writing it right now. Probably it’s like literally on somebody’s screen right now.

It’s a pretty good premise, and when I was brought in to do a rewrite on it it was Kevin James and Ray Romano as two incredibly agoraphobic guys who have to go on this adventure. I don’t even really remember the premise that knocked them out of their agoraphobic little happy niche, but they had to go on a road trip. So, it was two agoraphobes on a road trip.

And it was fine and I enjoyed writing it. It was like a true comedy comedy, which I don’t do very often, but I was just writer 14 out of 29 on it at this point. And it will be fascinating to see if that movie ever gets made.

**Craig:** Did you ever work on Stretch Armstrong?

**John:** I did not. But that’s another legend, isn’t it?

**Craig:** I don’t know how you even have a WGA card if you haven’t worked on that movie. [laughs]

**John:** [laughs]

**Craig:** That movie has had… — I worked on that very early in my career. I think I was the four millionth writer. I believe they’ve hit a billion. I believe they are officially in the billions. And the movie moved from studio to studio to studio. I mean, at some point someone — either someone is going to blow everybody away by figuring it out, or everyone will suddenly realize you can’t make a movie out of Stretch Armstrong. It’s boring.

**John:** The thing is Stretch Armstrong is like two-thirds of a good idea, but it’s that missing third that’s going to be really hard to ever reach. Because it’s sort of a good trailer, but I don’t know that we’re going to want to see that as a movie.

**Craig:** Yeah. The version that I wrote back with my partner, and this was sort of I would say 1997-ish, was a Tim Allen comedy, so there you go, it’s 1997. [laughs]

**John:** [laughs]

**Craig:** And it was Tim Allen in basically a family comedy where he’s a single dad raising a couple of kids and he gets stretchy powers. And it was very broad and goofy, but it was really about family and stuff like that, you know. And it wasn’t at all — it was so minimally about being a hero because, you know, at least then… I would say now I don’t acknowledge that stretching is a heroic property. [laughs] It’s simply odd.

**John:** There’s a reason Mr. Fantastic isn’t really that fantastic.

**Craig:** No. No. Not at all. It’s such an inappropriately named character. He’s Mr. Vaguely Interesting.

**John:** Ha! Yeah.

**Craig:** So that was that one. And that still hasn’t been made.

**John:** The other example you gave which is where during production there is a series of writers that come through is usually a giant disaster. And the exception would be the first Charlie’s Angels famously had, like a bunch of people came in during production. I was off shooting DC, my doomed television show, and they went into production. And all sort of the A-list kind of people came in and did a week. And they were like, “What is this movie? It’s going to be a disaster. This is going to be the worst thing ever.”

But, god bless them, everyone, like, did the best they could. So Zak Penn was on, and I don’t know if Simon was on the first movie, but everyone — people you couldn’t believe helped out for a week and god bless them.

And the movie was a wreck, but it all kind of pulled together in a way. And it was the weird kind of movie that can actually support the like 15 different tones all happening at once. And then I came back in and sat in the editing room for a long time and we reshot and it worked. So, sometimes it does work, but it’s a brutal way to make a movie.

That’s why you shouldn’t go into production without feeling pretty darn good about how your script is, unless you want to kill yourself.

**Craig:** Yeah, no question. Charlie’s Angels is one of those movies that almost its charm is almost in its strange, funky nature. You know? That because the title implied a very kind of drudging remake of what was basically a very bad TV show — I’m sorry, you know, just a goofy ’70s era procedural, very cheese ball show. To kind of come at it from such a wild angle really made it fresh and was cool, you know. Charlie’s Angels was a cool movie. McG did an awesome job on it.

**John:** Yeah.

**Craig:** And you did, as well, of course. And I guess Zak. I’ve got to give Zak credit. You know I hate that.

**John:** Oh, god, the worst.

**Craig:** The worst! I love him.

**John:** Just the worst.

**Craig:** I mean, I love giving him crap. And I love him also.

**John:** Yeah. I think he listens to the show, so right now he’s…

**Craig:** Hey Zak!

**John:** …he’s enraged.

**Craig:** He’s enraged. How can you tell? [laughs]

**John:** [laughs] How can you tell when Zak Penn is enraged?

**Craig:** I know.

**John:** That’s a good sort of a Zen question.

**Craig:** Yeah!

**John:** I just saw your trailer for Identity Thief, like the longer trailer for Identity Thief, and I loved it.

**Craig:** Oh! Awesome! Great.

**John:** And so I love Melissa McCarthy. And I love Jason Bateman, so these are good things. And I can stand you. But I was just really, really happy with it. I’m so happy for Melissa and that you gave her good stuff to do. And a lot of physical violence takes place against Melissa McCarthy. She gets hit by cars, and things are thrown at her, and…

**Craig:** Yeah. We put her through the ringer. I mean, I didn’t love the first trailer that came out, only because as a teaser it really was just about, like, “Here’s a couple of kooky jokes and here’s a basic idea for a movie.” And this longer trailer gives you a better sense of the fact that there’s a cohesive story and that there’s something happening and a bit of a journey.

What the trailer — and I love it, actually, too. I mean, I’m really happy with the trailer. And I don’t mean that in a braggy way because I didn’t make the trailer. Trailers are different things; they live apart from movies. And so I think the marketing guys did a really great job with it. And they are — as they should — they are selling the comedy because it is a comedy and there’s a lot of really funny stuff.

What the trailer won’t impart at all, and I don’t think any TV commercials will, so I’ll just sort of impart it, is that the movie actually has a lot of really touching stuff in it. And Melissa McCarthy, she makes you cry. I mean, there’s a couple of spots where she gets you.

And so I like sort of selling big comedy, which we have, and then kind of surprising people with something that’s quite human. So, I’m looking forward to it, but I’m glad you liked it. I liked the trailer, too, and naturally you will include a link.

**John:** Oh my god, of course.

**Craig:** And the movie is coming out February 8. You’ll be hearing about it consistently until then.

**John:** I didn’t realize it was coming out that soon.

**Craig:** Uh-huh.

**John:** Wow, that is really quick. So, that’s why you’ve been so busy getting that picture all finished up.

**Craig:** Oh, yeah, yeah, scrambling. Sitting with Seth Gordon, our terrific director today, and Scott Stuber, our awesome producer, and it’s been a real family on this movie. Everyone has gotten along and just… — It’s a funny thing, when people like a movie then your romantic notion of how everyone should work together is real. Everybody starts to feel like a family that’s raising a kid together, and everybody is looking out for the kid, and everybody is watching each other’s backs, and respecting each other and what they bring.

And, you know, when it’s not that way, that’s when things can sometimes go completely awry. But in this case everybody’s been just dedicated to it. Melissa and Jason have been just dedicated to it. And on the one hand I’m a little sad that I stole Melissa from you. On the other hand I’m full of glee.

**John:** Yeah. I can always get her back.

**Craig:** Try! You try. [laughs]

**John:** It’s not like she’s not busy at all. She doesn’t have a TV show…

**Craig:** I’m like — I’ve got a death grip on that lady.

**John:** Yeah. She’s just great.

So, people have to wait till February 8 to see the movie though, right?

**Craig:** They will have to wait until February 8 to see the movie.

**Craig:** Yes I did. And even though I know the name is Karateka I will always call it what I called it when I when I was a kid which is “Kerotica,” as in erotica.

**John:** When Jordan Mechner and I first started talking about making it, one of the first questions I had for him was like, “So, how am I actually supposed to say it?” Because I just remember the box that I got when we bought it, you know, it was a summer gift for ourselves, and I said “Kerotica,” because I didn’t even know what erotica was, but that’s just how you would pronounce.

**Craig:** Right.

**John:** But Jordan says Karateka. His official word is that you can actually pronounce it however you’d like to pronounce it. He will gladly take any pronunciations.

**Craig:** Fantastic.

**John:** So, we’ve been out on Xbox, and Steam, and PS3, but now the iOS version is out and done and I’m so happy because this is the one I’ve spent the most time myself doing, because while I play Xbox and PS3 they’re not my sort of native things. And I’m very much iPad. And so this is the one I sort of got to sink my teeth into and figure out how we’re going to translate all of the stuff that would happen with controllers, how we could do it in a touch way, and sort of how we could figure out how to make this game feel right and playable when you’re just on an iPad.

**Craig:** Yeah. And it’s a good game. The things I like about it: One, I mean, just the nostalgia factor; being able to say I’m playing Kerotica again is really cool. And I don’t play Karateka but I do play Kerotica.

**John:** Yeah.

**Craig:** The iOS games that are not puzzle-oriented sometimes suffer from clumsy controls. I don’t like playing shooters on iOS. I just find it really annoying. But the controls here are elegant, and simple, and transparent to you while you play, which is great.

**John:** Cool. One of the things we had to figure out is the interface for — it is sound-based, so as you’re playing the game you can sort of hear the rhythm of like sort of how they’re going to attack. You can figure out your blocks based on the music that’s playing. The problem with the iPhone, or the iPad, too, is like, what if you’re on the subway and you’re playing and you don’t have your headphones on? You don’t want to be annoying around other people.

So, we had to figure out an interface for how to show you, give you symbols that would show you what’s coming up, even if you have the sound turned off. And so that was the stuff that took like the extra months. People kept asking, “Hey, when is it coming out on iOS?” It was figuring out that stuff.

**Craig:** Well, time well spent. And the other thing I like is the — and you talked about this before — a rather unique approach to handling death in a video game, because usually you get unlimited lives and death comes with either no penalty or kind of a setback penalty where you have to go back to a checkpoint.

And here your lives change who you are and your character and the possibility of success. There are levels of success, and if you can manage to play through the whole game without dying you achieve the true success of the game. But if you don’t, your character actually becomes sort of different. And in that way you have also kind of created a very novel approach to difficulty management because the typical scheme is that you start a game with a setting — easy, medium, hard.

In this game there is a setting and as you fail the game gets easier, but in doing so rewards you less should you succeed in the end.

**John:** Exactly. The reward of the game is completing the story with your true love, and that’s the ultimate mission. So, you’re going to be able to keep fighting and keep going, but as a slightly more powerful but slightly less desirable guy. And it was Jordan’s idea, god bless him. And the next thing about a screenwriter, like Jordan, figuring out how to tell game stories is like he really thought about like, “Well, what is the story consequence of dying?” Well, the story consequence is that she doesn’t get to marry her true love. She gets to marry the next guy who comes along who’s not… — but it’s not love.

So, it’s been fun to see that play out and people really respond to that.

**Craig:** Very cool.

**John:** Cool. Craig, it’s time for One Cool Thing.

**Craig:** I don’t know. I actually have one, so that’s already a shocking thing. But you decide who goes first.

It’s sort of big nerd adventure story, so adventure story in the sense of like it’s Da Vinci Code or like a Raiders of the Lost Ark, but very, very nerdy in the best possible way. And it involves fonts, and fantasy novels, and Google Books scanners, and it’s just really terrifically well done. And so I think people who are interested in things that screenwriters are interested in, who are listening to this podcast, would probably dig it.

**Craig:** Very cool. I still, in the back of my mind, you’ve told me that I haven’t done this before, and in the back of my mind I feel like I have. But I’m sure one of our intrepid listeners will call me out if I’m duplicating.

But, you and I both attended a party thrown in John Gatins’ honor last night. John Gatins is the screenwriter of Flight, which is getting a lot of attention this awards season, as well it should. John is a terrific guy. And at that party I met a gentleman who used to sing on Broadway. In fact, he played Marius in Les Mis on Broadway.

And I’m a big musical fan. Obviously you are, you’re making a musical. And for awhile now I’ve been listening to SiriusXM on Broadway in my car with satellite radio. And SiriusXM on Broadway has this fantastic — it’s not fair to call him a DJ because he — I don’t know how you would describe him.

**John:** Host. He’s a host.

**Craig:** He’s kind of a host. I guess he’s sort of a host of huge, long, four-hour blocks of programming. And his name is Seth Rudetsky. And Seth is an accomplished musician and he works on Broadway, typically as an accompanist and a musical guy. And he’s been around for a really long time in the Broadway world and he’s amazing. He’s just a really smart, smart guy.

And what I love about Seth Rudetsky is that he combines these things that mean something to me only in combination. He has an excellent grasp of music theory, dramatic theory, and the theory of musicals if we can posit that such a thing exists, so a very good sort of intellectual theoretical understanding of that stuff. He also has amazing practical experience. He’s actually done it. He knows what it means to start a show from start to finish, succeed — he knows what it means to succeed, he knows what it means to fail. He knows how the sausage is made.

And lastly he is incredibly good at actually conveying those insights that he has to the average listener and the lay person. So, when you combine all three of those things you learn so much from him, sometimes in these little short bursts. And it got me thinking that that’s really, I think, what you and I aspire to when we talk about screenwriting are those three things in combination. And Seth Rudetsky is the Scriptnotes of Broadway.

And I am a big fan of his. I’ve never met him. You have met him?

**John:** I feel like I met him. In the travels I’ve encountered him in someplace, and so I think I shook his hand. But I listen to his show as well and I think he’s terrific. And, again, I would aspire that our show could do a little bit more of that. And as we start doing more interviews in 2013, I think that’s a good place for us to be in is to have people talking about the craft in an enjoyable way.

And we can interview people as they talk about their experiences the way he interviews them talking about how they made their shows.

**Craig:** Yeah. And you know what he does that I love? Sometimes before he plays a song he’ll talk about a tiny little moment in the song that you would never notice. But he’ll talk about why it’s good. And he has such a passion for it. And so he’ll say, “Just listen for that moment and here’s why it’s important because of this.”

And then you hear it and you go, “Oooh!” Like, for instance, there’s a song You Can’t Get a Man with a Gun. And it was written for a belter. And he was talking about how when you write songs for belters like Ethel Merman who originated the performance of that song, that you want to find those moments in a song that allow the belter to belt.

And he says, listen, you know, in the chorus, [sings] “You can’t get a man with a gun. With a g-uUN.” And that whole like “g-uUN.”

That whole thing is really designed to let Ethel Merman just be Ethel Merman.

**John:** Yeah.

**Craig:** And I’d never really thought about that before. And then he plays the song and you’re like, “Whoa, he’s right.” [laughs] “There it is! Brilliant.”

**John:** I second your recommendation. He’s terrific. And that’s on XM. And XM is actually kind of wonderful.

I never had XM until we got this new car and it came with three free months of XM and you quickly become addicted. And so, of course, then you start paying the monthly subscription.

**Craig:** Well worth it, for Seth Rudetsky alone.

**John August:** Hello and welcome. My name is John August.

**Craig Mazin:** My name: Craig Mazin.

**John:** And this is Scriptnotes, a podcast about screenwriting and things that are interesting to screenwriters.

So, Craig, we’re pretty busy, aren’t we?

**Craig:** We’re pretty busy guys. I’m making a movie. You’re making a Broadway show. I saw that your… — Well, I mean, it’s going to be a Broadway show but right now it’s a Chicago show.

**John:** It’s a Chicago show. We announced finally — for Big Fish — we announced our out of town dates. So we are going to be going to Chicago in April for a five week run at the Oriental Theater. It’s just so exciting, because originally when we started the podcast I was sort of allowed to talk about Big Fish: The Musical; I wasn’t really allowed but I didn’t really ask permission. And then they sort of said, “Hey, could you stop talking about it?” So I stopped talking about it.

But now I can talk about it because it’s real. And we’re going to be in Chicago in April. And singing and dancing and making a musical.

**Craig:** Fantastic.

**John:** And it’s really great. So, tickets are on sale for like big group sales now. But eventually individual tickets will be on sale. And there will be a link in the show notes.

**Craig:** Very exciting. Yeah, I can’t say much at all about anything to do with Hangover 3 other than that we’re making Hangover 3. That’s the sum total of what I’m allowed to say. [laughs] And then I will say no more.

**John:** It’s interesting with Big Fish because I can now say like, “Hey, we’re going to Chicago and these are the dates.” And there’s so much more information…

Oh, I can also say that Norbert Leo Butz is starring as Edward Bloom.

**Craig:** I saw that. Very talented guy.

**John:** He’s phenomenally talented and so we’re so excited to have him as part of the show. But of course there are like a thousand other things I know that I’m not allowed to say. So, I can basically say anything that was already in the press release. And the press release — it’s so fascinating when you’ve read and approved the press release and then you see it with the news stories that come out from the press release, because they are sometimes more graceful, sometimes less graceful rewritings of what was already in the press release. And figuring out sort of how to prioritize the information for a given audience’s interest in what was in the press release.

**Craig:** I find that “entertainment journalism” is the shoddiest, least fact-checked form of what has already become a very shoddy un-fact-checked medium of journalism.

Journalism has suffered over the years, but entertainment journalism is horrendous. Like you say, you put a press release out on the world, and you would think, okay, there really is no need for a game of telephone here. There’s a press release. Just say what is in the press release or don’t. Or say some of it, or say none of it. But then they’ll just get it wrong.

**John:** Yeah.

**Craig:** It’s amazing. They’ll spell names wrong. They’ll just make stuff up. And then, because of the internet, if one mistake is made it is perpetuated a million times.

**John:** So not specific to this case really, although there is one sort of questionable case, but I hate when they do sort of lazy Googling. And so they find something and they’re like, “Oh, I’m going to throw this in so it feels a little bit more original.” And so they’ll throw in some random thing about the show which is not actually correct, or about a movie I worked on that is not actually correct at all. And that will be part of the official story from then on.

Or like they’ll throw in a credit for me and I’m like, “That was not mine. Why are you doing that?”

**Craig:** It’s so weird. I remember when we made Scary Movie 3, and this is back in 2003, sort of before the internet really went cuckoo nuts. And when Bob Weinstein announced that he was going to make Scary Movie 3, he said David Zucker is going to be directing it, Craig Mazin and Pat Proft and Kevin Smith are going to be writing it, because he had this idea that Kevin Smith would somehow be involved. But really I think Kevin Smith had said, “I’m actually doing something else — it would be fun to sort of, I don’t know, read the script at some point or talk to those guys.”

And it was smart for him to kind of use a name that people are interested in. But Kevin Smith actually never worked on the movie. And when I say never worked on it, I mean, I’ve never spoken to Kevin Smith in my life. He literally never did anything with it. And that was the last time his name was mentioned was the very first press release to announce that the movie was even being made.

He was still being cited as a writer in reviews of the film, just because they Google.

**John:** They Google.

**Craig:** Yeah. It’s remarkable.

**John:** They do Google.

**Craig:** Remarkable.

**John:** But, you know what? On our podcast I think we can do better than lazy entertainment journalism and we can do proper fact checking sometimes. And we can do follow up. And so I thought we would start with two little bits of follow up.

**Craig:** Great.

**John:** So, first, a personal follow up. Because you had in a previous podcast recommended a really — well, I’m spoiling here, but you recommended a really good documentary called Jiro Dreams of Sushi, which I saw last week. And you know what? It was really, really good.

**Craig:** I didn’t lie.

**John:** No. So I’m endorsing your endorsement. The one thing I wanted to follow up with you about though is when you were talking about it you were talking about Jiro’s pursuit of perfection, which is so true about the documentary. You see this guy, and he’s obsessing about absolutely everything about how he is making his sushi, and how he is seating everybody at the counter, and how he is making certain sushi smaller for the women than for the men because he’s just figured it all out because he’s been doing this for 75 years, which is crazy.

And you were trying to relate it to screenwriting, which is natural because we’re a podcast about screenwriting. But it struck me as I was watching, because you put that idea in my head, like perfection in screenwriting: You really couldn’t do a Jiro of Screenwriting, because everything that we do as a screenwriter, or really in most of the creative arts, every sentence we write is a brand new sentence.

**Craig:** Right.

**John:** Every project we tackle is a whole new set of challenges. So, Jiro has the luxury, or sort of the curse — he chose to make it a luxury — of doing the exact same thing every day. And because he could do the exact same thing every day he could optimize it and perfect it in a way that may not be a realistic goal for a screenwriter or any writer.

**Craig:** True. In fact, it sort of underscores why the search for perfection in screenwriting is so fruitless, because here’s a man who actually has controlled out every other variable other than make tuna sushi. And yet he still can’t perfect it.

We are constantly being asked to make sushi that doesn’t exist. And, also, other people are involved. And, also, we actually can’t do it because other people are doing it, because it’s screenwriting. So, inevitably — you know as they say a movie is written four times. It’s written, it’s cast, it’s shot, and it’s edited. The ultimate authorship of a movie is collaborative no matter what you do.

So, we are that much further removed from the possibility of perfection just by the nature of our process. It was instructive for me to watch somebody who you think almost maybe could achieve it because of the specificity of what he does, and he, too, was saying no, not possible.

**John:** But I do endorse the movie. And it was terrifically well made. And fun to see someone who could devote their life to a specific thing and not have it feel like a tragedy. Because as I first sat down to it, I was like, “Oh no, this is going to be a sad story about a man who wasted his life making sushi.” And that’s not how you leave the movie, which is nice to see.

**Craig:** Yeah. Good. I’m glad you saw it.

**John:** A second follow up thing is we had a question maybe two weeks ago on a writer who wrote in from Iran who had written in with a very specific sort of copyright question.

**Craig:** Yes.

**John:** And basically saying that Iran doesn’t sort of respect or doesn’t protect the same copyrights, so what is he supposed to do? And so we had a reader writer in, which is what I hoped would happen. Alexia wrote in and she said, “For sure you do not have to be a US citizen to enjoy copyright on your work via the US Copyright Office any more so than you have to be a US citizen to register a trademark at the Trademark Office.”

And then she says, “I can speak to this from personal experience.” So she’s done this. I think she’s a European writer who’s registered at the US Copyright Office. She also goes on to say, “The idea of transferring copyright to a US-friendly person is iffy.” It’s one thing we sort of brought up, if you have a friend in the US, do you have them register it for you? “US Copyright Law actually has clauses in place to stop this from happening as a guard against exploitation. Generally speaking, copyright can only be transferred under a contract of employment.”

**Craig:** Right. I actually did do some offline research into Iranian copyright law. It is…it’s a little funky. I mean, law in general in Iran is a little funky because it is a theocracy bordering on totalitarian state. And so the way laws are implemented is a touch whimsical, as we all know.

They are not signatory I believe to the Berne Convention. So, while they may be members of WIPO which is a — I can’t quite remember the details. Their copyright protections are not as strong as those in other countries, nor are they as strong as those in the United States in terms of their treaty arrangements with other nations. Part of the issue with Iran is they don’t respect other people’s copyrights as well as they ought to.

**John:** Exactly. So, for the writer, who wrote in a couple weeks ago with that question, it seems like one solution would be to just get it registered in the US Copyright Office. You’re going to have protections under the Berne Convention for every place other than your home country, which seems crazy, but is probably helpful if you’re that writer.

**Craig:** Yes, I agree. For sure.

**John:** So, today, Craig, I thought we would answer eight questions. Some of them are big questions. Some of them are small questions, but it’s sort of a sampler platter of questions that a screenwriter might have about the craft, the profession, the words on the page. So, shall we try?

**Craig:** Yeah. I’m excited.

**John:** Great. So Sarah writes in. She’s a writer who lives in Los Angeles. “Recently a friend/assistant at a studio passed a video pitch onto me of this guy briefly describing a premise for a sci-fi film.” And actually in the show notes I’m going to send a link to this pitch, because it’s on YouTube or Vimeo or one of those.

“The pitch itself isn’t overly specific, but I was told from his video pitch that he was able to get a few meetings. Is pitching an idea via the web a good idea? Isn’t the probability of the idea being stolen much higher?”

**Craig:** [laughs]

**John:** I knew you’d laugh here.

**Craig:** Here we go again.

**John:** Lastly, “Could this be the evolution of pitching? If so, I may be screwed because I don’t know if I could even sit in front of a camera.”

So, I watched his video and I’ll send it through to you to watch, Craig.

Essentially it’s a guy sitting at his computer or laptop describing this sci-fi project. Sometimes there are little popup windows to show specific images that he wants to talk about. But it feels very much like if you were in the room with this guy and he was like pitching you a project, that’s kind of what it feels like. And I was actually kind of impressed by it in that he was straightforward, it was direct. It felt like, okay, I can see what this guy is describing in his movie.

So, could you envision a scenario in which people are pitching movies via YouTube?

**Craig:** Absolutely. I think it’s inevitable. First of all, look at the generation that’s coming. They are the most exhibitionist generation in human history, and not because they are innately more exhibitionist, but because they have a channel for exhibition. And I see nothing wrong with it.

I’m not at all surprised that you liked it. The people who shouldn’t do this are people who frankly are not good in any room. For instance, Sarah is already uncomfortable at the thought of sitting in front of a camera. I suspect that she may be just as uncomfortable sitting across from three jaded executives who are hungry and just want to go to lunch.

But if you are good at pitching, why not? It makes total sense to me. Inevitably somebody will talk about the thing that makes me the craziest, which is the unfounded paranoia that somebody is going to steal your idea. It is less likely, frankly, that somebody is going to steal your — and let’s stop saying “steal your idea” because it’s not steal-able, it’s not property — but it is less likely to me that somebody is going to steal your unique expression if in fact you’ve put it on the web and dated it. Now there is blatant proof of your primacy of authorship. But please understand: Your idea is not something you own — I’m so sorry — so it cannot be stolen. There isn’t an idea that’s going to make your career. It’s not about ideas. It is about your ability to write.

**John:** I agree.

A few points I would make here. First off, the idea of a video pitch: Yes you could make a video pitch and put it on YouTube for the whole world to see. Where I think it might be a more likely scenario for a lot of these people is that you make this video and you send it so somebody but as a private video, so you’re not putting it out there for the world to see. Or you’re sending it to a specific person to describe what it is you’re trying to do.

And really it is an extension of what we’ve already seen happening for the last 10 years, which are these sort of rip reels or rip movies where you are trying to describe what a movie feels like and what a sequence feels like, and you go through and you pull sections from other movies to sort of give you the sense of feel for what the movie is going to be like. Directors have been doing this for a long time.

Joe Carnahan quite famously this last month or two did one for Daredevil and it leaked out online, or he put it out online, so everyone could see that this was the Daredevil movie that he was going to make. This is really the earlier version of that. This is saying what the idea of the movie is. If I were in the room describing it to you, this is what it would be like.

A second point: The reason why pitches are usually done in person is so the person can ask you questions. So, this same kind of thing could happen via Skype and that would be the same kind of thing. What I saw I saw in this YouTube video really could have happened in a Skype situation.

**Craig:** Right.

**John:** That I think is going to be incredibly much more common.

The third thing I would remind you of is there is this idea that Hollywood is sort of one way, and that you are always going to be — that a new generation is going to come in and have to pitch to people who are in their 40s, and 50s, and 60s. No, you’re going to be pitching to people who are your same age. So, if you are comfortable with being on a camera and talking to a camera or looking at things in a YouTube video, if that is something you’re comfortable with in your generation, the executives you’re going to be pitching to are going to be comfortable in the same way.

Everyone sort of enters into the industry at sort of the same age. So if it’s a generational thing that you do make YouTube videos then that is going to become the thing.

**Craig:** Sure. And finally I will point out that, as I’ve said many times, what we are selling primarily is comfort. We are trying to inspire confidence. And if you can do that through your video, they are going to look at you and say, “Not only is that an interesting story, but this person makes me feel comfortable. They seem like they’re in control of their story and they seem like somebody I could talk to in a room, and not a weirdo.”

Please understand: When you are out there and you are new, you are not simply competing against me or John; you are also competing against the thousands of people out there who have broken through the gates and been really weird. And so they’re just scared of weirdos. It’s a nice way to inoculate yourself against that.

**John:** And in a strange way, even if they are hiring a writer, they’re hiring you to write this thing so they should be concerned about the words on the page, a video is telling them a little bit more about like who you are actually are as a person.

So if they had a writing sample and they could see you pitching this thing, they could put them together and say like, “Oh, that’s a person I could probably work with.” And that could be really helpful.

**Craig:** Yeah, for sure. I like it. It’s a good idea.

**John:** Next question. Chris asks, “What do you and Craig think of HSX.com? If you haven’t heard of it before it’s a stock market esque game based on the film and television industry. If a film is green-lit its IPO is on the market, or it becomes an IPO on the market. The price of the stock is based on a one dollar to $1 million in domestic box office gross in the first four weeks. Additional options become available when the movie opens in theaters. I’d be interested to hear you guys discuss it.”

So, Craig, have you ever played HSX.com, or gone to the site?

**Craig:** I was a very early kind of high stakes player…

**John:** I kind of guessed that.

**Craig:** …way, way back when it first began.

**John:** I think I was still in film school when it started out, or an early version of it.

**Craig:** Yeah. It goes back to the ’90s. I don’t know if you remember, for awhile they were in the old Ritz Furniture Building in West Hollywood.

**John:** I do. And they used to have a stock ticker that would go past.

**Craig:** That’s exactly right. Yeah. They’ve been around for a long time. It’s a fun concept. I find that their stock prices are rarely accurate to what I know, because in part, you know, the market for instance, the real stock market will build into prices things like, “Maybe this new car company’s car won’t actually happen and they’ll go out of business, so we have to kind of price that in.”

You and I will know for instance, “Okay, this movie that they’re not sure is happening is really, really happening.” So, sometimes the early stock prices tend to be too low, too depressed. They get things wrong all the time.

However, it is an interesting bellweather. I like to go on — for instance, Identity Thief, one thing I like is I went on to look at Identity Thief, and I don’t know what the price is right now, but they can also show you how many players are holding the stock long, that is to say they believe the stock will outperform the number that’s listed there, and how many are holding it short — they believe that the stock will underperform. And it was like 95% to 5% holding it long. That’s encouraging to me. It means that people are actually — that the people who play are optimistic about the movie.

I like stuff like that. In the end, nobody in Hollywood looks at HSX for anything. It is just a game. It is highly inaccurate. But, the people who play it are into movies and love movies. And I have no problem with that; I think it’s cool.

**John:** Yeah. I have not looked at it in a decade, so I wasn’t even sure it still existed until this question came through. It’s interesting if you’re interested in it. I don’t go to visit it. No one makes their decisions based upon it. All these kind of things like that, or Box Office Mojo, they’re interesting in those moments where that data could actually be helpful to you, or where you’re just thinking, like, “Well what is everyone else thinking about this thing?”

I have a movie coming out, Frankenweenie, October 5th. And like I’m curious what people think it’s going to do. But I’m not going to like — hopefully — stay awake at night worried about it, because it is just kind of guessing at a certain level.

**Craig:** Yeah. Now there was very briefly, I think Cantor Fitzgerald which is an investment house floated a real version of HSX where people actually could purchase real futures based on movies. And very wisely the legislature killed that. [laughs]

**John:** Yeah, because talk about insider trading. We know so much about that stuff.

**Craig:** Exactly. It just would have been insane. I mean, just insane. Anybody that wasn’t in the business playing that would have been such a sucker and had such a kick me sign on their back, I can’t even believe they entertained it for a minute.

**John:** Yeah. Just deliberately tank a weekly rewrite to bring something down.

**Craig:** [laughs]

**John:** We would never do that…

**Craig:** Never.

**John:** We have too much integrity.

**Craig:** Never.

**John:** Never.

**Craig:** Never!

**John:** Next question will be so short. Sam in Los Angeles writes, “Is there anything that can be done about cell phones in movie theaters? Are the people in the industry aware or is there any sense of what to do about it? I imagine it is of great concern to the movie industry as it’s ruining the exhibition of the movies they create. I had an unpleasant experience at ArcLight last night. There were cell phones all around me. Even though I tried politely to ask them to stop it didn’t help.”

**Craig:** Yeah. I’m sorry, Grandpa. No. There’s nothing we can do about it. I mean, look — go to a movie theater where people don’t do that, I guess. I mean, I’ve never…

**John:** But that’s the ArcLight! That should be the ArcLight?

**Craig:** Are they respectful? I mean, people are respectful, generally. I’ve never been in a theater where people were going crazy with cell phones.

**John:** Yeah. I’ve been to those, but that wasn’t the ArcLight.

When I was working on Big Fish: The Musical — which I can talk about now — a lot of times I just go right from work to see a movie in Times Square. And that’s not the ideal audience to see a movie with in that they tend to be a heavily tourist crowd. There’s a lot of cell phones going on and you just sort of roll with it.

**Craig:** Yeah.

**John:** But the ArcLight should be better than that. I don’t know, I would say, yes, ask with sort of authority saying, “Hey, can you get off your cell phone?”

**Craig:** You can ask. I mean, look — the bottom line is if somebody, [laughs] everybody knows they run a thing in front of the movie saying shut your cell phone off. So, if they’re not shutting it off and there’s a bunch of people not shutting it off, they’ve already decided they don’t give a damn. You’re in the wrong theater or you are at a move that’s for teenagers who just don’t care. It’s part of their experience, and I’m super sorry dude, but that’s life.

I remember going to see Commando when I was in high school. I went with my buddies. We went to go see Commando. And half the audience was drunk, the other half was high or stupid or all three. People were going nuts, and that was the point, it was Commando for god’s sake.

**John:** Totally. It’s Commando.

**Craig:** I mean, I can’t imagine people are going to see…like The Words is opening this weekend. I don’t think people are going to be on their cell phone in the middle of The Words. It’s not going to happen.

**John:** [laughs] “Yo! He stole that book!”

**Craig:** [laughs] By the way, well, maybe I’ll save it for my — I’m going to save it for my Cool Thing.

**John:** All right. Next question comes from Peter in Prague. I love that we have people in Prague. I kind of always pick the person who is writing from overseas because it’s just awesome.

**Craig:** It’s cool.

**John:** “In your podcast you often refer to a studio. How many studio execs are usually involved in the decision-making process and give you, or have permission, or are saying ‘yes’ or ‘no’ to move a project forward? How formal or informal are these sessions? Do you have to persuade them and fight for every word? Are you given a list of do’s and don’ts? What is that process like working with studio executives?”

**Craig:** Oh, that’s a good question.

**John:** It’s a very good question, Peter from Prague. And it shows some insight into how the US film industry works which is not how the overseas film industries work.

**Craig:** Right. Well, obviously it changes from studio to studio. Some studios are very committee like and other studios are a little more autocratic. There are levels at each studio, and roughly the level is you have a creative executive, there is a vice president, there is a senior vice president, there is the president of production, there is the chairman of the studio. And then floating above them is some sort of corporate master.

And depending on who you are and where the development stage is, you may be dealing with somebody low on the totem pole, in the middle or at the very top. It all depends on who you are, what the project is, and at what point in the development process it is.

The meetings themselves aren’t formal, per se; it’s not like you go in and defend your thesis in academia. All meetings ultimately are informal. It’s people sitting around a table talking through what they think. You rarely are given any kind of — a list of do’s and don’ts. There are notes which are the studio’s opinions and suggestions of what to change and what to keep.

Generally development is a very informal process. I find it to be an informal process.

**John:** Usually with a project you’ll have one person who’s your point person on the project. And if you are a newer, less expensive writer that person might be a creative executive, so a junior-ish person whose responsibility is to work with you, and the two of you will work together a lot. And then they’ll read the script and then it will go up to the next person who will give more notes. And the next person will weigh in with stuff. And I should also say there is often a producer involved who should be doing some of that work, too, and that can be convoluted, too. So you’re dealing with a producer, then you’re dealing with the creative executive.

But from the creative side, there is generally a junior person. There is a senior person, and that senior person doesn’t have green light power, but it is his or her movie. Like that person will get some credit for making that movie. At a certain point the decision goes up to a studio president who is going to be the green light person who will say, “Yes we are making this movie,” or, “We are not making this movie.” Decisions about big actors will go to that person.

And sometimes they will get involved in very specific story things on a movie. With the Charlie’s Angels movie, I’ve told this story before so I apologize, but we were at like a Friday 5pm meeting with Amy Pascal who was the President of Sony at that point. And she said, “Okay, we are going to cut $5 million out of this budget and we are not leaving until we do it.”

And so she sort of flipped through the pages and she ripped out five. And she’s like, “Okay, these are gone. Write around them.” And it was frustrating, but that was also sort of her job. She’s like, “I can tell this is an expensive sequence. We don’t need it. Take this out and that is the decision to make.”

A person at that level would get involved in a project that had challenges, that had some filmmakers who needed to be dealt with by a person at that level.

You often won’t get involved with the chairman of a studio or some really giant person who is sort of a corporate person until a first test screening, and then that person shows up. And that’s when, like, for Charlie and the Chocolate Factory, “Oh, there’s Alan Horn.”

**Craig:** Right.

**John:** Because that person is showing up there. This is a movie we’ve made. He is here because the president of marketing is there, too. We have to figure out how we are going to sell this movie and that becomes an important process for him as well.

**Craig:** Yeah. Good rule of thumb: The more you are being paid, and the more the movie costs, the higher level you’ll be dealing with, because naturally there’s simply more accountability to it. The one thing I would add also is that nowadays it is increasingly common — I think essentially it is the rule now that the head of marketing is part of that green light committee.

In some cases, in some studios, the head of marketing is part of the “should we even develop this at all” committee, because — as we’ve mentioned before — the cost of selling movies actually outweighs the cost of making a lot of them. And so marketing becomes enormously important.

**John:** Agreed. Next question is from Charles. It’s about sharing credit. So, Charles writes, “I decided to team with two individual screenwriters I met on a filmmaker’s social networking site with the idea of collaborating on something together. I came with the initial premise and through subsequent online meetings the premise morphed and the writing began. They each wrote a scene and then flaked out, so I kept writing. One of them read the first draft and gave me some notes. The other one never even read it. So, I’ve registered the script with the WGA under my name only because other than a block of description, a sentence or two of dialogue, and some ideas tossed around in the online meetings, they really didn’t write anything. If I was lucky enough and a company wanted to option or buy this spec do I mention the other two collaborators? Do I…”

**Craig:** You have to.

**John:** “Should I include them with any potential buyers?”

**Craig:** Look, this is a disaster, okay?

**John:** Yes. This is why you don’t do this.

**Craig:** Yeah. You really, really, you just don’t do this. It’s a disaster because the truth is you’re right, you’ve written 99% of this thing. And any of the discussions and the sort of pie-in-the-sky things, those are — that falls under producing, sort of. You know, writing is writing, it’s creating literary material. The fact that they have even a word in this script causes you a huge headache.

You may think, “Well, I don’t even have to mention it.” When you sign an employment contract you warrant in that employment contract under penalty of near death that every word in that script is yours.

**John:** Yup.

**Craig:** And if they come after you, and they come after the studio, the studio will turn to you and say, “You screwed us. And we’re not covering your butt.” See, normally, when the cuckoo army shows up, when they hear that a movie is being made to say, “Oh, you stole my script!” You know, like in Hangover 2 some nut job said you stole my life, whatever that nonsense was. The studio — they pay for everything. You’re indemnified. They cover it. They’re like, “These are our guys, we’ll take care of them; we’ll deal with these lawsuits; it’s nothing — it’s silly.”

But if you actually did use somebody else’s stuff and put your name on it, brother, you got a world of hurt coming.

**John:** You do. So, I don’t have the right solution for this guy right now other than sort of like build a time machine, go back, and don’t do that again. If you really wrote every word — if you wrote 99% of this, go back and rewrite the 1% that they did write. Make sure that they don’t have any — that there’s nothing that’s theirs that is in there.

Now, you did talk with them originally about this idea and this movie, and I think you need to go back to them. I would go back and sort of retroactively say some sort of shared story, “This is how we’re going to collaborate on the story of this,” and make it clear that you wrote this whole thing, but you want them to be acknowledged somehow.

**Craig:** Listen. If I’m your lawyer I know exactly what I would say.

**John:** Tell me.

**Craig:** You have to go back to these guys and offer them some amount of money, $500, $1, $1,000, whatever it takes ultimately to purchase them out as works-for-hire for you. And now you’re covered.

**John:** That’s a good… — See, listen to Craig.

**Craig:** But, it’s a negotiation all of a sudden. And, you know, any time people feel like they have leverage on you they’re going to squeeze. So, now all of a sudden you’re into a lawyer, plus you’re into them. It’s a disaster. You can’t — you guys: Never do these things. Never do this sort of thing. It’s just a disaster.

**John:** Yeah. And this would have been easier if he hadn’t already said that he wrote the whole script. But they now know that he wrote the whole script, so they know that they have leverage.

**Craig:** Yes. Exactly. If you do it before that, you say, “Listen, guys…”

**John:** “Listen, do you guys really want to do this? Let me just buy you out of this because I think I really want to write this whole script and you don’t seem that into it.”

**Craig:** “I’ll give you each a couple hundred bucks and some Starbucks cards and get out of my life.”

**John:** Yup. That would have been great. It’s not going to happen that way.

**Craig:** No. [laughs]

**John:** Here’s a happier story. This is a tweet from Kelly Gibler. She writes, “My script made semifinals for both Austin and Sundance. I want to get some representation. What should I do?”

**Craig:** Oh, didn’t we do the “how do I get an agent” thing?

**John:** No, but this is a… — I phrase this, put this under “capitalizing on some heat.”

**Craig:** Okay.

**John:** Because here’s the thing: It’s great that your script made semifinals. That’s useful. So, it’s a somewhat different situation than like, “I just wrote a script…”

So, here you wrote a script that’s actually pretty good. That’s a distinction between I think the general case scenario of like “I want to get an agent,” because maybe you’re no good. Well, she’s actually probably pretty good because she made semifinals. So, that’s great.

So, what does she do with this little bit of heat that she got off of making semifinals? Suggestions, Craig?

**Craig:** Well, hold on a second: We don’t know that she’s any good from semifinals. I’m talking now as a perspective agent. All we know is that she’s not super duper bad.

**John:** True.

**Craig:** You have to win one of those things for me to think that you have actual heat. I mean, there are a billion people in semifinals all day long. To me that doesn’t mean anything yet. I don’t think there’s real heat yet.

**John:** I would advise Kelly Gibler, me being the sunshine and rainbow part of this podcast, I would advise her go to Austin. Go to Austin because you’re a semifinalist. And go in Austin and see what Austin Film Festival is. And as you meet people there and as you meet agency managers, because there will be some there, be like, “Hey, I have a script that is a semifinalist.”

Talk to them about it. Don’t be overwhelming with it. Just happily give it to them. Get business cards. Send them your thing. Just try to schmooze it up as much as you can.

You can also do that online. I would say you are not going to get real agents probably to read your thing, but there are going to be some agents’ assistants at some of the agencies who are, like, they’re looking for somebody. They’ll read your script because you’re not just nobody. You’re somebody who has a little bit of validation because you made some level there.

If only it gives you enough incentive to feel like you can introduce yourself to somebody, that’s a good thing.

**Craig:** Yeah, I’ll be meaner about it, or just glummer I guess. I think you have to win. I don’t think semifinal means anything. I think you have to win. And even when you win, there is questionable heat. That’s how grumpy I am about the state of affairs of getting an agent.

**John:** I feel like I need to mention the Nerdist Writers Podcast every podcast that we do. But I was listening to one that had a panel of people, and unfortunately it’s very hard to tell their voices apart, so it could have been Kyle Killen or it could have been somebody else on the panel. But he was crediting his wife or his girlfriend saying, “She made me go to this party and she made me talk to the agent, and I was so nervous about doing it, but then he read it and he really liked it, and that got me started.”

**Craig:** Good.

**John:** And so sometimes you have to just be awkward and uncomfortable and make that first conversation and you never know.

**Craig:** It’s a funny thing. Actually I love that story because it proves, frankly, that actually just standing next to somebody telling them something interesting is worth so much more than finalist Austin Film Festival. And I say that as somebody that’s judging [laughs] the finals of the Austin Film Festival this year for screenwriting.

**John:** That’s awesome.

**Craig:** But it’s not about — I mean, I think if you win it is important. But there is no replacement for eye-to-eye contact.

**John:** The other reason she should go to the Austin Film Festival, of course, is that we are going to be doing the first ever Scriptnotes Live at Austin Film Festival.

**Craig:** Yay!

**John:** We have absolutely no details because we really don’t know anything about what’s happening with the Austin schedule. But, we’re going to be there and we’re going to be doing this kind of podcast, this kind of conversation, but with a giant room full of people.

**Craig:** Huge room. Sick.

**John:** It’s going to be exciting. I’m not going to be nervous. I’m just giddy about it. It’s going to be really fun. And I think we’re going to have an awesome guest.

**Craig:** [laughs] You’re giddy!

**John:** I’m giddy.

**Craig:** Oh, that’s great. I’m glad. One of us should be giddy about it.

**John:** Our next question is from Erin in Chicago. She says, “I recently completed an Associate Degree of Nursing. Near the end of my program I realized my passion is screenwriting rather than nursing. Coincidentally, also began to make arrangements to move to Los Angeles prior to finishing nursing school. I’ve heard you say that if you want to learn the industry your best bet is to get some sort of job in the industry. While you and Craig have been clear on your views on the necessity of film school, or lack thereof, the advice always presupposes that a person has an undergraduate degree, which I do not. Is it possible for me to find an industry job without a BA? Or should I start looking at colleges again?”

**Craig:** Oh god. Argh. This is where I want to be super supportive and give you the answer I’m supposed to give you per the manual of being supportive. But really what I want to tell you is: be a nurse, because it’s so hard. I get so scared at the thought of somebody who’s in nursing school — we need nurses. God knows we need them.

**John:** America needs nurses.

**Craig:** And they’re going to move to LA and they don’t have a college degree. And they don’t…

John, am I just too down?

**John:** No. You’re not too down. But I think we can take your frown and turn it upside down.

**Craig:** Thanks.

**John:** And make it good. Here’s the thing, Erin: You have an Associate Degree in Nursing, and that’s awesome, and that’s very relevant to nursing. I think you’re going to have a hard time getting one of those classic industry kind of jobs with an Associate Degree in Nursing. Because it’s not like people have, “Oh, you have to have an Ivy League degree,” or something, but everyone you’re going to be competing with for those jobs is going to have, like, an Ivy League degree, or at least like a pretty good university degree there.

And so it’s not like people are looking at resumes that carefully, but they’re going to notice that you don’t have that. But, here’s what you do have with a Nursing Degree and the move to Los Angeles. You have a job. And a job is a really good thing.

**Craig:** Yeah.

**John:** So I would say: Move to Los Angeles, be a nurse, take extension classes at UCLA where you’ll actually learn screenwriting, and just learn screenwriting. And learn if screenwriting is what you actually really want to do. And if it is what you really want to do, no one is ever going to care whether you’ve got a Bachelor’s Degree or Master’s Degree or whatever.

I have an MFA. No one has ever cared.

**Craig:** Seriously.

**John:** The degree itself matters nothing.

**Craig:** Exactly, like Diablo Cody.

**John:** Diablo Cody.

**Craig:** I don’t know if she has a degree. Who cares if she has a degree?

**John:** No, she’s awesome.

**Craig:** She’s awesome. And she wrote a great script.

Listen, this is really important. People will write into us and they’ll say, “I realize that my passion is screenwriting.” You don’t know what screenwriting is, okay? Because it’s a job and you’ve never done it. Your passion is writing. And you like the idea of writing screenplays, but that’s not what screenwriting is. Screenwriting is a job where you write and also get punched in the head a lot. And also are on set. And also are in meetings. And also kind of produce and handhold, and cajole, and hustle.

There are moving parts to this you can’t imagine yet. And so the thought that you’re now — not only is the pyramid…the pyramid preexists you, but you’re now digging down and putting another layer in which is, “Well, but before I can really start the incredible uphill climb becoming a screenwriter I first have to go to college now so I can start the uphill climb.”

And I’m like, oh god, I just want you to be a nurse and write. And John’s answer is perfect. I hope you take his advice. Move to LA. Be a nurse. Put money in your pocket. Pay your rent. Not freak out and worry. God knows you don’t want to pile on tuition loans at this point in your life — it’s crazy and pointless. And take extension classes. And read screenplays, and watch movies, and write scripts.

And if it happens, it happens. And if it doesn’t, you’re helping people and you’re earning money, thank god.

**John:** Those are good things. Has there been a great movie about a nurse? One Flew Over the Cuckoo’s Nest, but that’s not really what I’m talking about.

**Craig:** No.

**John:** So write that great nurse movie.

**Craig:** Right. Or TV show. I mean, there is a Nurse Jackie, but that’s one kind of nurse show.

**John:** Well, yeah, I mean, ER is kind of a nurse show, too. But, yeah, come on. I would say be an awesome nurse. Keep your eyes open. Figure out what the story is about nursing. Write that movie and win an Oscar. Done.

**Craig:** Please. For everyone: Do not take on debt to be a screenwriter. That is a super stupid thing to do.

**John:** Yeah. I agree with you. I think if you were getting a Bachelor’s Degree, that’s awesome, and making you a fully actualized citizen, I’m okay with some debt there. I will say like as an alumni of USC Film School, which is kind of very expensive, I shouldn’t say that you shouldn’t take on debt for it, but it’s questionable, I’ll give you that.

**Craig:** My point is don’t take on debt to be a screenwriter. There are degrees — some people are wealthy, and a liberal arts education for them is a luxury that they indulge in, and that’s great. Some people are not, but they do it because they foresee an improvement in their potential for salary. And so there is an investment. And it’s not simply debt; it’s an investment. I understand — it should pay itself off and then some.

But, there is no educational investment that’s worth making that requires debt to be a screenwriter, because the odds of you being a working screenwriter are very, very small. And also the thing that you’re going into debt for will not help you be a screenwriter, okay? But being a nurse…it’s wonderful.

**John:** Being a nurse is wonderful. So, being a nurse is wonderful. The only thing, my defense of film school, even for screenwriters but less so for screenwriters than other crafts, is that you are paying that money to enter into a cohort of incredibly motivated film people who will be your peers and allies for the next 20 years, which was very much my experience coming out of the Stark Program. The only people I knew in Long Angeles were my 25 classmates. And they have been incredibly helpful to me my entire career. And I would not be here without them.

**Craig:** But to me, I call that the two school exception. If you get accepted to NYU Film or USC Stark or Film, go. Because you’re right — there is a real potential for value there. If you are not, don’t.

**John:** Yeah. I agree with you there. Last question is from Kenneth. He writes, “I want to write a screenplay based on a foreign novella that was written in the 1930s. I contacted the translator of the translation I love and he said that it hasn’t been optioned, but he recommended I also find out if the original foreign text has been. I plan on doing that, but there’s a further complication. It was already adapted to the screen in the ’70s.

“So, in order to write a fresh adaptation do I simply arrange an option with the original text publisher, or will it be an arrangement with the company that owns the ’70s adaptation of the film? Since the book has already been adapted what do I do?”

So, I can start and you can correct me when I get something wrong.

**Craig:** Yeah.

**John:** When in the ’70s they made that movie, they bought the film rights to that book. And so in buying the film rights to that book, they probably still have the only rights to make the movie version of that book. So you will not be able to make a new movie version of that book without negotiating with the people who made that film. You disagree?

**Craig:** Not necessarily true, especially if it was made in the ’70s. A lot of times the rights cycles were not in perpetuity. These days corporations are way too smart. They license everything… — Well, the way they license things, there are usually cycles to the licensing, but once they actually exploit the license by making the property, they get an exclusive right to adapt that property for that medium for in for eternity throughout the universe…

**John:** “All known or unknown…”

**Craig:** But in the ’70s it may have been that there was a limited rights cycle, even if you were to make the movie your rights to make a movie based on that property expired after a certain amount of time. So actually the first step: you would go back to the original text — the translations are essentially irrelevant — go back to the original text, original author, that publisher; find out what the situation is with the rights, if they are available for adaptation. Sometimes films are adapted in one country but the worldwide rights or the US rights are still available.

It can be complicated.

**John:** Yeah. I would amend this to say that you do need to go back to whoever owns the foreign rights. You want the foreign book rights, whatever that is, that’s the core rights there. I would not take them at their word that they have all the rights to something. There could be other encumbrances that you’re not aware of.

You don’t want to spend years of your life trying to do this thing and then have it be shut down for something that you can’t understand or control. And I say this as a person who just very recently went through a strange situation.

**Craig:** There are companies that do these title searches, right?

**John:** Yeah. So they can do a copyright search that would be helpful. But as much digging as you can do the better you’re going to be in the long run.

**Craig:** Yeah.

**John:** And I say this from personal experience, two things that happened to me very recently were just like, “Whoa?! These are giant corporations; they should have figured that out and they didn’t.” So…

**Craig:** Yeah, for sure.

**John:** So Craig, it’s time for One Cool Thing. Do you want to go first? Should I go first?

**Craig:** I’ll go first because One Cool Thing did come to mind. And it’s The Words. It’s this movie opening, and by the time you hear this podcast it will be out in theaters near you. It’s called The Words. And I saw an early cut of the film and I loved it.

**John:** This film stars Bradley Cooper and Zoe Saldana.

**Craig:** Bradley Cooper, Zoe Saldana, and Jeremy Irons. And so I really loved the movie. And it’s about writing. It’s about writers.

**John:** Isn’t it about stealing an idea? It’s about copyright?

**Craig:** And I sort of thought the whole thing is a really interesting meditation on how all writers feel, even in moments of inspiration, a bit like a fraud, because did they write it? Or where did it come from? And should I take pride in what I do? Is it mine? Did it just happen? It’s an interesting movie for writers.

Now, I have to say: Today I saw that it was coming out and I went, “Oh yeah, that movie — I really liked that movie.” And I checked to see what kind of reviews it was getting, and it was getting ripped apart by critics, and I was shocked. Shocked.

And I felt really bad for the filmmakers because I actually thought they did a spectacular job. Maybe I’m the only one. Maybe people out there will see this movie and say, “No, the critics were right.” I just think the critics were off base. I really, really enjoyed the movie.

And, yes, I’m friends with Bradley, and it’s not about, “Oh, Bradley Cooper needs more people to go see Bradley Cooper movies.” It’s a very small movie. I think it was made for like $4 million. I really loved the story. And I loved the way the story was structured. So, I don’t know, I thought it was a Cool Thing. I stand in defiance of the critics. I say it’s a Cool Thing.

**John:** So here’s the thing about the words for me is it stars Bradley Cooper and Zoe Saldana, who are beautiful people. So as long as it’s relatively well shot you get to look at beautiful people for 100 minutes.

**Craig:** Having sex at one point.

**John:** See? Come on. You sold a ticket right there.

**Craig:** She is…

**John:** She is stunning.

**Craig:** And I’ll circle back to Bradley, but she is stunning. I met her once, very briefly. I was standing outside with Todd Phillips at Warner Bros. We had a little spot where we would stand. He used to smoke. He doesn’t smoke anymore, but he would go outside to smoke and I would stand with him. And she came by because it’s this alleyway — it’s famous people alleyway. They’re coming and going all the time. And he knows everybody. I don’t know that many people, but I get to sort of secondarily enjoy meeting these people.

And sometimes you meet famous people and they are so beautiful on screen and then you meet them in life and you think, “Oh, you’re somehow diminished by reality.” She’s actually more beautiful in real life. She is unbelievable. I just thought she was gorgeous.

Bradley, [laughs], is also really, really good-looking. And it just makes me angry sometimes. I just look at this guy and I’m like, “What is the deal?” Like, “How did you get that hair? How did you get that face? This sucks. Why do I look like me?”

**John:** And then he breaks out his fluent French and you just want to kill yourself.

**Craig:** Oh, and then it’s just, “Come on, bro.”

**John:** So I shared a mat with Zoe Saldana because she used to workout at the same gym as I used to workout at. At first I wasn’t sure it was her because I agree with you that she is incredibly pretty and she’s one of these people who is actually noticeably pretty even outside of all the glam and all that stuff. But when you see people in workout mode, they’re smaller and they’re just doing their thing. And so they’re not able to carry themselves in their sort of beautiful mode.

So, I noticed her, but I was like, “Ah, she’s really interesting.” But it took me half an hour to sort of go, “Oh, …and that’s Zoe Saldana.”

**Craig:** I think this is your might be gay moment, like you might be gay if…

**John:** You don’t notice her…

**Craig:** You’re working out next to Zoe Saldana sweating…

**John:** No, I noticed she was pretty…

**Craig:** …and it takes you a half an hour. I mean, dude. She’s so…

**John:** Yeah.

**Craig:** But, look, the truth is I’m 40% gay for Bradley. I really am. He was on the cover of, I don’t know if you saw this, he was on the cover of the Hollywood Reporter this week.

**John:** No. I don’t get that.

**Craig:** Well, I mean, I saw a copy of it on the newsstand. And the picture of him, oh my god — it’s just not fair.

**John:** I remember Bradley Cooper from Alias, and he was always the one, like, “Why are you not being highlighted more?” He was comparatively the nice chubby guy on that show, which was absurd.

**Craig:** I know, but now…

**John:** Because he was the best friend. He had sort of no real function.

**Craig:** And he really is one of the… — There is something about male stars in Hollywood, the real iconic Hollywood faces, as they get older they just get better looking. It’s fascinating. It really is.

**John:** One of my theories with that is that we just become so accustomed to looking at their faces and knowing, like, “That’s a handsome person,” that our idea of what handsome is becomes that thing that they are at the moment.

**Craig:** I understand. Yeah. There is another thing though that happens with men. See, to me, masculinity is obviously — a part of being handsome is masculine features. And I think as men get older they tend to lose more facial fat…

**John:** They get harder.

**Craig:** …and there’s a certain weathered, masculine rugged thing that begins to happen and sort of accentuates the masculinity. And they just look manlier and manlier as they get older. Like, I see a picture of Brad Pitt and there is gray in his beard and suddenly he’s cooler looking all of a sudden. Whereas unfortunately for women it seems like the world perceives the opposite — as they get older somehow because I guess femininity is so closely linked to youth or something.

**John:** Yeah. You had brought this up in an earlier podcast, and I thought of it after we recorded it, my counter example, because you were complaining everyone was like, “Oh, for a woman in her 70s she’s so beautiful.” And you were like, “No she’s not.”

Helen Mirren I will say is actually the exception to me. And I know everyone sort of brings up Helen Mirren, but I think she’s genuinely sexy at her age.

**Craig:** Yes. You’re right. Helen Mirren, yes.

**John:** Because you see her in a swimsuit and you’re like, “Wow, she actually has an amazing body.”

**Craig:** Yeah. And I don’t mean to come off as a sexist. It’s just one of those biological things. The male brain — I tend to find younger female faces more attractive. Oh boy, here I go. Here comes the mail box. But, what am I gonna do? But, you’re right: Helen Mirren is beautiful. And there are older women that are beautiful, don’t get me wrong.

But in general, you look at these male stars like Clooney. Look at Clint Eastwood. I mean, Clint Eastwood is 80-something years old. And he looks almost skull-like at this point, and somehow that makes him really good-looking. That’s bizarre.

**John:** Prior to a few weeks ago I would have more gone with you there. How much do you not want to be Trouble with the Curve right now? The Clint Eastwood movie coming out.

**Craig:** You know what? I don’t think it impacts it at all. I really don’t. I’m serious. I don’t think that that — I mean, you’re referring to his strange speech to a chair.

**John:** Yes.

**Craig:** I don’t think that people do or don’t go to movies because Clint Eastwood spoke. I mean, you think it’s going to impact the box office?

**John:** Here’s why I think it could impact the box office is because the moment that there’s another narrative, another narrative overtakes the narrative of the movie, it really I think hurts a movie. And my example for this is Charlie’s Angels 2.

So Charlie’s Angels 2, we have the three angels coming back, and, like, they’re bigger stars than ever, and Demi Moore who I — I fought for Demi Moore. I love Demi Moore; I think she’s awesome. But, the only thing we could actually get people to talk about in the two weeks before the movie came up was her relationship with Ashton Kutcher and her showing up at the premiere with Ashton Kutcher and Bruce Willis.

And so like we’re throwing this $2 million premiere for the movie and all the cameras are tuned out to these people who aren’t the stars of the movie. And that’s all the press we got was that.

**Craig:** And I get that. But here’s the thing: That story overlaps with the general movie-going interests than Oval. Because people who are interested in Charlie’s Angels 2 are also really interested in who Demi Moore is sleeping with or not sleeping with or whatever. But I don’t think it overlaps movie-wise.

And, also, don’t forget that there are a lot of Republicans out there and I think they tend to do — you know, the Republicans…

**John:** It honestly may be fine for it.

**Craig:** And the conservative movement tends to do well at putting people on busses to go to things because they’re in support of it. Don’t be surprised if churches show up to Trouble with the Curve.

**John:** We’ll see how it turns out. So, Craig, my One Cool Thing is a thing that I just can’t believe is real. So let me describe it to you. As we talked about at the head of the podcast, you are a very busy guy. Like, you’re making a movie, I have a movie coming out, and you’re going to be busy throughout the fall and into the winter, right?

**Craig:** I am.

**John:** I also know that you’re really big on deadlines. So, if you were out sick for a week that would be a really bad thing, wouldn’t it?

**Craig:** It would be disastrous.

**John:** Yup. And so it’s a weird thing because I feel like because we work for ourselves there’s this assumption, like, “Oh, you can be sick and it would be fine.” It’s like, no, it’s actually kind of even worse to be sick by ourselves because we don’t really have sick days. And I guess if we’re not in a busy period of time it’s not so bad, but if we’re in a busy period of time it’s kind of awful. And especially if you’re on a weekly, I mean, I don’t want to ask you what your weekly quote is, but it could cost you a lot of money.

**Craig:** A lot.

**John:** A lot.

**Craig:** I’m not saying for me, [laughs], I didn’t mean to be bragging, like, “Yup, a lot.” I’m saying in general, yes, weekly…

**John:** Yes, it would be a lot.

**Craig:** Yes, it’s a lot of money — for the average screenwriter it’s a lot of money.

**John:** So, this is pretty amazing, and I don’t know why people aren’t talking about it more. It’s this insurance you can buy, so you can only buy it once a year, but here’s what the insurance does: If you get sick they will send somebody out to do your job for you.

**Craig:** [laughs]

**John:** No. Listen to me here. They will do your job for you. So you will still get paid, but you also won’t fall behind.

**Craig:** That doesn’t work for us.

**John:** It actually works for us. That’s the most remarkable thing. Like you think, “Oh okay, that would make sense if you were a data entry clerk,” but it works for everybody. It doesn’t matter what your profession is. It works for everybody.

**Craig:** But how would it work? We’re hired for our unique ability. How could somebody…

**John:** You want to think that you are irreplaceable.

**Craig:** …AETNA to come work on your pages?

**John:** So you’re basically irreplaceable is what you’re saying?

**Craig:** Well I’m not saying I’m irreplaceable. I’m replaceable by you. But I’m not replaceable by a guy from State Farm.

**John:** Yeah, okay. But, I mean, it’s very hard to find somebody else to do your job. And so you really don’t want to be out sick for a week.

**Craig:** I mean, I definitely do not want to be out sick for a week.

**John:** So, here is what you do. So you go to this place and you pay them $30, $20 to $30, it takes five minutes, you fill out a little form, and then you won’t get sick.

**Craig:** I don’t understand. [laughs] Oh, because they come and do your job for you?

**John:** No, it’s even better than that. You don’t even get sick because they give you a flu shot. All you do is you go in, you get your flu shot…

**Craig:** Ah, I see what you’re doing.

**John:** Ah-ha! So you go in, you get your flu shot, and it’s basically not getting sick insurance.

**Craig:** You scamp!

**John:** I’m a scamp. So, this is really me pitching the flu shot, because people don’t get their flu shots and I don’t understand why people don’t get their flu shots. Do you like being sick? No, you don’t like being sick. So, pay your $20, go to Target. I went to Target this week and I got my flu shot. It was $28. It took me five minutes to do. They do this new special little needle thing so it doesn’t even go into your muscle, it’s just like in the surface of your skin. It is the easiest thing in the world.

And why don’t people get their flu shots? So, here’s the thing about the flu: Look, you’re probably not going to die of the flu. If you’re a grownup it is very unlikely that you’re going to die of the flu. But you could be out of work for a week. Being out of work for a week is terrible. You don’t want to be sick for a week. So don’t be sick for a week. Spend your $28 and get the flu shot.

**Craig:** You know, I’ve got to congratulate you. You suckered me in completely. I actually did believe that there was a service that would come and do your job for you for a week. I feel really stupid. I feel even stupider for arguing with you about it, but I’m glad that you did this. I’m glad you fooled me. I’m glad you exploited my gullibility, because you are absolutely right. Get your flu shot for sure. Get all shots, by the way. Please get everything.

**John:** Yeah. I know. And so I don’t want to — we talked before. You and I both believe in vaccinations and childhood vaccinations, and that can be a whole separate topic. And I’m not on a soap box. I’m not saying you have to get it. I’m just saying like why wouldn’t you get it? If there’s a 10% chance that you’re going to be out sick for a week, why take that 10% chance? That’s terrible. Don’t do that.

**Craig:** Well, I mean, there’s one reason you don’t get it, and that’s that it is part of a government sponsored conspiracy in conjunction with big pharma to inject you with mind-controlling substances.

**John:** Yes. So if that is your belief, don’t get the flu shot. Just don’t do it. And don’t write in with your conspiracy theories. But I would also say like on a movie like Hangover 3, do you think they’re going to get flu shots?

**Craig:** No. No.

**John:** But they should, shouldn’t they?

**Craig:** I mean, well, the only issue is sometimes there is a reaction. Like you may have one grumpy day. So I could see where they might consider sponsoring a flu shot tent if it were on a Friday.

**John:** Maybe.

**Craig:** Not in the middle of the week. But, yeah, you’re right. I mean, it’s actually a pretty great thing. It’s pretty smart. And by the way, I’m getting my flu shot this weekend because of you.

**John:** Good. See? I’ve kept one person working in the industry. I’m a job creator. I am.

**Craig:** You are. We built this podcast. We built this. And you are a job creator.

**John:** If nothing else I increased productivity one iota in Hollywood just for my recommendation.

**Craig:** Somebody has to.

**John:** Yeah. Craig, thank you so much for another fun podcast.

**Craig:** A year of podcasts.

**John:** I was going to say it’s hard to believe, but it’s actually not hard to believe. It feels like 52 episodes to me. Does it feel like it to you?

**Craig:** I don’t think so. To me I would have… — If you had said we were over 40 I would have still been a little skeptical. I don’t know. They just go by kind of quickly.

**John:** They do. But I’m happy that we made it this far. I’m happy that people seem to be liking our show, so this is a good thing. And last week you treated us with a song.

**Craig:** A song.

**John:** That was very nice, Craig. Because we actually just let you play it out I didn’t get to sort of clap or applaud afterwards or hold up my little virtual lighter, but I thought you did a terrific job, so thank you very much for doing that.

**Craig:** Thank you. How nice of you to say. There were a lot of lovely comments from people on Twitter.

**John:** Good.

**Craig:** I now get to say stuff like, “Yeah, it’s blowing up on twitter, y’all.”

**John:** Mm-hmm.

**Craig:** Although it’s not really blowing up. But it was fun to do and I think maybe I’ll do it again if we can get to…150?

**John:** Sure.

**Craig:** Yeah.

**John:** We’ll see.

**Craig:** We’ll pick an appropriate benchmark, because we can either do it more regularly or you could really go nuts and just say we’ve got to hit 500.

**John:** Yeah. That would be a lot. Another option might be a benchmark of like where we rank on iTunes, because that might be a little bit more indicative of people who are listening to it now or subscribing now versus just people who are catching up on previous episodes, because downloads can be people who are just going back through the whole catalog. We need those new, fresh listeners for some imaginary metric that doesn’t really mean anything because we’re not selling any advertising. So it’s just ego gratification, really.

**Craig:** Yeah. Well, that’s what this is all about.

**John:** And on the topic of ego gratification, last week I… — we were doing the Three Page Challenges — and while reading one of the Three Page Challenges, I speculated that one of the people who wrote in was not a native English speaker. And you took a little umbrage at that. You took umbrage on his behalf that I did not believe that he was a native English speaker.

**Craig:** Yeah. Yup.

**John:** And I was right. So, Mario DiPesa wrote in to say, “I am from Montreal, Quebec and my native language is French. Although as most Montrealers I’ve been exposed to English at a pretty early age through TV, comic books, and movies, I’ve only been in the US for about five years and I just started using English as my main language.”

So some of his odd word choices that I noticed, that was because English is not his native language.

**Craig:** You were absolutely right. I was completely wrong. And I’m embarrassed, because this is the kind of thing I feel like I should be good at. It’s language. You picked up on something. I’m mortified. And the only way I can think of to rectify this error is to kill you. [laughs]

**John:** [laughs]

**Craig:** If I kill you, I feel like I set it right.

**John:** Yeah. There are times I’m very happy that we’re not recording this in the same space, that you are far off in Pasadena while I’m safely here in Hancock Park at an address you’ve never been to.

Ah, that’s not true; you’ve been to my house once.

**Craig:** I have. I’ve been there. I know exactly where to go. And I know exactly how I’m going to kill you. [laughs] So enjoy this victory.

**John:** Yes. By the time this podcast airs it will be past.

**Craig:** You’re dead.

**John:** But I wanted to talk a little bit about sort of what I noticed in Mario DiPesa’s writing and the sense… — Because it wasn’t ungrammatical in the sense of “these are the rules of English and he broke the rules of English.” It wasn’t that at all. Like everything in it was by the rules grammatical. But grammar is really how we speak; it’s how a native person speaks. And it didn’t sound like how a native person would use the language.

And that’s something I want to start talking about. We’ll get into some questions later on, but I want to start talking about this and get your feedback on it.

A lot of times when we talk about English and we talk about sort of people coming in from other languages, we always assume there’s a one-to-one correlation between the things we do in English and the things that people do in other languages. But that’s not really true, and you start to notice those things as you meet people who are writing in something that’s not their native language.

One example that often occurs to me is the sense of time. Because when you think of time as being, well there’s the past, the present, and the future, but if you actually listen to how we speak, our sense of time in spoken language and written language is actually quite a bit more complicated.

We have actions that were started in the past and completed in the past. We have actions that were started in the past but are still ongoing. We have things that we think are going to happen. Things that we know are going to happen. It’s much more complicated and a lot of languages treat it very differently.

One thing I notice from time to time is our nanny who is native Spanish speaking, her English is fantastic but she — if you ask her like what did she have for dinner tonight, she says, “Oh, she eats green beans and broccoli and chicken,” which would actually be a really good meal for my kid because my kid is a terrible eater. But she says, “She eats,” or like I’ll ask did she have a bath, it’s like, “She does.” And so she’s answering back in our present tense verb for something that we would use a past tense verb. And that’s just the way that Spanish works versus how English works.

Their sense of what you use the present tense for is wider than what we use the present tense for. In Spanish they put a wider umbrella over the present tense than we do in English. And so those things don’t match up perfectly.

**Craig:** No, that’s true. And the language where you’ll see huge differences like that, where it’s not even subtle, is Chinese. The Chinese language has a bunch of quirks. We would call them quirks. I assume that they would look at our language and call our language quirks. Here’s a sentence that — you can’t ask the following question in Chinese: You can’t say, “You’re not really thinking of doing that, are you?” They don’t recognize negatively phrased questions.

**John:** Yeah. And in Spanish that would kick into the subjunctive probably. And it’s more complicated. And I think people want to reduce things to simple rules that like could be machine translated between things, and it’s more complicated than that. It’s more subtle.

**Craig:** Yeah. There are a lot of strange things, just the way that — and I think we’ve had a Chomsky festival before on this podcast — but the grammar that we use reflects our consciousness and the way we think about things. But there are gaps. And you obviously picked up on a very subtle one in Mario’s language that I did not. I’m still going to kill you over this.

**John:** Which is fine.

A reader a couple of months ago sent in through — he had gone to one of those paid coverage services and he sent through the coverage. And it was too long to really talk about either on the website or on the podcast, but looking through it, I was a little bit frustrated by what this reader wrote in terms of his comments, like things to change in his script.

And it was something like he was criticizing him for using the passive voice. And the example the guy cited was something like, “Mary is cooking dinner.” And the reader said, “No, it should be, ‘Mary cooks dinner,'” which is wrong sort of on two levels. First off, that’s not passive voice.

**Craig:** Right. “The dinner was cooked by Mary” is passive.

**John:** Exactly. So passive is any construction in which the subject of the sentence is receiving the action of the verb. So, “The casket is lowered into the ground by the men.” That’s a passive voice.

And, first off, there is nothing wrong with a passive voice. There are a lot of reasons why you might want to use an active voice and there are a lot of reasons why in screenwriting you should be thinking about, like, “Wait — does the active voice make more sense for this?” Rather than “The blindfold is removed,” it’s like, you know, “The bandit removes the blindfold.” There may be reasons why the active voice works better for you. That’s not to say that passive voice is wrong.

But with, “Mary is cooking dinner,” that’s actually the present progressive, and that’s like a remarkably good thing that English has that not every language has. The present progressive is that “ing” form, so the “to be” plus an “ing.” So, “Mary is cooking. Bob is running.” And what’s great about the present progressive for screenwriting is that you can interrupt it. And so if a scene starts with, “Todd is running down the street.” You can — “Todd is running down the street when…” something happens. You can stop that action.

If it’s, “Todd runs down the street,” well, does he finish running down the street? It implies that something has been completed when it may be something that you want to stop midway.

**Craig:** This is one of those “rules” that you hear tossed around by halfwits on the internet who don’t know anything about what it means to write a screenplay effectively. They’ll say things like, “Go through your script and remove all ‘ing’ verbs.” No. No. Swallow poison, idiot, because that’s the… — These reductive nonsense rules that people use for screenplays make me crazier than anything.

Of course there are times when you want to say “is running’ or “is doing,” especially in a screenplay which is attempting to invite the reader into an immediate present. Something is happening RIGHT NOW. Isn’t that more dramatic than a thing happened?

So, not to highjack this and turn it into a celebration of my hatred for so many people, but you definitely hit upon something that invokes great umbrage-taking from me.

**John:** Oh, it wouldn’t be a year anniversary podcast without some umbrage.

**Craig:** Mm-hmm.

**John:** And really most of these so-called “rules” are people trying to implement Latin and English, or they’re trying to sort of pull rules from a perfect language, which they believe to be Latin, into English. So they say, “Well, Latin doesn’t do this so therefore we shouldn’t do this.” Like Latin doesn’t break up infinitives, so like, “To slowly roast…” they won’t put a word in between the “to” and the infinitive form of the verb. And so therefore we shouldn’t do it.

Well, Latin is different. And in English it tends to make a lot more sense to split up that infinitive in a lot of cases. And if it sounds better to the ear, well that’s the point.

**Craig:** I’m with you on that. Like I don’t understand the whole rule against split infinitive. Who cares? Sometimes it’s much better and much more expressive to do it that way. I’m not one of these people that fetishizes avoiding prepositions at the end of a sentence. It’s all silly.

And certainly when we talk about writing, the nice thing about screenwriting is you can write anything you want because it’s not going to be read.

**John:** Yeah. A weird thing happened in a script that I just finished, and Stuart and I went back and forth a couple times on this one line of dialogue. And the line is, “Ethics is easy when you’re winning.”

And so is it “ethics is easy” or “ethics are easy when you’re winning?” And so when you actually look it up it turns out ethic and ethics are two different words and they actually mean two different things.

**Craig:** Yes.

**John:** So it became a very subtle, like, “Well what is the definition of this?” “What is the definition of this?” “What is the real sense in which the character is using this?” But it also became, “Which sounds better coming out of someone’s mouth?” “Which would you actually say?”

**Craig:** You could do it either. I think you could do it either way presuming that you’re not talking about the study of ethics but rather individual ethics, like having ethics. You could say, “Ethics is easy,” meaning the concept of having ethics which is silently implied. Or, ethics — plural — having them “are easy.” I think you could do either one.

But if you were talking about “ethics is easy when you’re winning,” meaning the class where they teach ethics, that would be “ethics is.”

**John:** The class Ethics — Ethics 101 is easy in winning.

**Craig:** Or the study of ethics or the field of ethics.

**John:** But ultimately it came down to which is going to sound better coming out of this character’s mouth, because this character isn’t going to know the distinction between these two things. I mean, maybe if he were a linguist he would… — If he were a linguist he would use the right one.

But he wasn’t a linguist. He was a sports coach, so it didn’t make sense he would actually say the grammatically correct one or the definitely correct one. So it’s which one sounds better.

**Craig:** There you go.

**John:** I thought this would be a good transition into some things that will always sound terrible. And this was a list that a listener sent in, which I thought is just terrific. It’s from Go Into The Story, and it’s a list of bits of dialogue that you should probably always avoid.

And so it’s a lengthy list and we’re going to do our best to sort of sell you on how they sound and why you should never hear them. They will all be familiar to you. And if you were going to use any of the lines we’re about to state, you can, but you’re going to have to spin them somehow to take the curse off them, because they are all kind of cursed lines.

**Craig:** Hmm. Or just don’t use them.

**John:** Or just don’t use them. But I would say in a comedy there is probably a way you could use them, but you’d have to do something very smart to spin it in a new direction. Or not.

**Craig:** Yes. I agree. Some of these unfortunately are already attempts to spin something. They are jokes that have been beaten to death, so I don’t know how you spin something that’s already poorly spun and over spun.

**John:** Yeah. Jane Espenson defines these as “clams.” And so they were funny once but through repetition they become really not funny and smell horrible.

**Craig:** Yes. [laughs] Correct. Clams.

**John:** So shall we do this? “Are you ready?”

**Craig:** “I was born ready.”

**John:** “Are you sitting down?”

**Craig:** “Let’s get out of here!”

**John:** “_____ is my middle name.”

**Craig:** “Is that all you got?” “I’m just getting started.”

**John:** “Are you thinking what I’m thinking?”

**Craig:** “Don’t you die on me!”

**John:** “Tell my wife and kids I love them.”

**Craig:** “Breathe, dammit!”

**John:** “Cover me. I’m going in.”

**Craig:** “He’s standing right behind me, isn’t he?”

**John:** “No, no, no, no, no, no, I’m not going.” Cut to them going.

**Craig:** “No, come in. _____ was just leaving.”

**John:** “You better come in.”

**Craig:** “So, we meet again.”

**John:** “We’ve got to stop meeting like this.”

**Craig:** “Well, if it isn’t _____.”

**John:** “I’m just doing my job.”

**Craig:** “You give ______ a bad name.” / “Calling you a ______ is an insult to ______.”

**Craig:** “Lookin’ good,” said into a mirror.

**John:** “Now, where were we?”

**Craig:** “What the…?”

**Craig:** “If I’m not back in five minutes get out of here,” or, “blow the whole thing up,” or, “call the cops.”

**John:** “What part of _____ don’t you understand?”

**Craig:** “I’m not leaving you!” “You have to go on without me.”

**John:** “Don’t even go there.”

**Craig:** “I’ve always wanted to say that.”

**John:** “Ready when you are.”

**Craig:** “Is this some kind of sick joke?”

**John:** “Oh, ha, ha, very funny.”

**Craig:** “Did I just say that out loud?”

**John:** “Wait. Do you hear something?”

**Craig:** “It’s…just a scratch.”

**John:** “How is he?” “He’ll live.”

**Craig:** “I’m…so…cold!”

**John:** “Is that clear?” “Crystal.”

**Craig:** “What if…nah, it would never work.”

**John:** “And there’s nothing you or anyone else can do to stop me.”

**Craig:** “You say that like it’s a bad thing.”

**John:** “Note to self.”

**Craig:** “Honey, is that you?”

**John:** “What’s the meaning of this?”

**Craig:** “What seems to be the problem officer?”

**John:** “What’s the worst that could happen?” / “What have we got to lose?”

**Craig:** “I have a bad feeling about this.”

**John:** “Leave it. They’re already dead.”

**Craig:** “Don’t you think I know that?”

**John:** “Whatever you do, don’t look down.”

**Craig:** “Why won’t you die!”

**John:** “I eat guys like you for breakfast.”

**Craig:** “Oh, now you’re really starting to piss me off.”

**John:** “We’ve got company.”

**Craig:** “Hang on. If you’re here, then that means…uh-oh.”

**John:** “Oh, that’s not good.”

**Craig:** “Awkward!”

**John:** “What just happened?”

**Craig:** “We’ll never make it in time!”

**John:** “Stay here.” “No way, I’m coming with you.”

**Craig:** “This isn’t over.”

**John:** “Jesus H. Christ!”

**Craig:** “It’s no use!”

**John:** “It’s a trap!”

**Craig:** “She’s gonna blow!”

**John:** “Okay. Here’s what we do…” And cut to a different scene.

**Craig:** “Wait a minute. Are you saying…?”

**John:** “You’ll never take me alive.”

**Craig:** “Okay. Let’s call that Plan B.”

**John:** “I always knew you’d come crawling back.”

**Craig:** “Try to get some sleep.”

**John:** “I just threw up in my mouth a little.”

**Craig:** “Leave this to me. I’ve got a plan.”

**John:** “No. That’s what they want us to think.”

**Craig:** “Why are you doing this to me?!”

**John:** “When I’m through with you…”

**Craig:** “Impossible!”

**John:** “Wait! I can explain. This isn’t what it looks like.”

**Craig:** “Showtime!”

**John:** “You look like you’ve seen a ghost.”

**Craig:** “If we make this out alive…”

**John:** “That’s it! You’re off the case.”

**Craig:** “How long have we known each other?” “We go back a long way.”

**John:** “Well. Well. Well.”

**Craig:** “Ah-ha! I knew it!”

**John:** “Done and done!”

**Craig:** “Leave it. He’s not worth it.”

**John:** “In English please?”

**Craig:** “As many of you know…” and then a bunch of exposition.

**John:** “Too much information!”

**Craig:** “Yeah, you better run!”

**John:** “Unless…” “Unless what?”

**Craig:** “What are you doing here?” “I was about to ask you the same thing.”

**John:** “So, who died? Oh…”

**Craig:** “You’re either brave or very stupid. ”

**John:** “Oh, yeah? You and whose army?”

**Craig:** “Now that’s what I’m talking about.”

**John:** “Don’t call us. We’ll call you.”

**Craig:** “It’s not you. It’s me.”

**John:** “This just gets better and better.”

**Craig:** “This is not happening. This is not happening!”

**John:** “Make it stop!”

**Craig:** “Shut up and kiss me.”

**John:** “I’ll see you in hell.”

**Craig:** “Lock and load!”

**John:** “Oh, hell no!”

**Craig:** That was too white. [laughs]

**John:** [trying again] “Oh hell no!”

**Craig:** Yes. I love that one.

“Not on my watch!”

**John:** “You just don’t get it, do you?”

**Craig:** “I have got to get me one of these.”

**John:** “I could tell you, but then I’d have to kill you.”

**Craig:** “It’s called _____. You should try it sometime.”

**John:** “That went well.”

**Craig:** That did go well.

**John:** And scene.

**Craig:** So that was a pretty great list of awful, awful lines to not write. And there are so many more. I mean, people can write in. It’s a fun game of coming up with the cliché awful lines. I think in comedy it’s particularly embarrassing when you trot one of these things out as if you haven’t already seen it a hundred times on a sitcom. And for dramas, these kind of overwrought lines are actually indicative usually of stories and character issues.

I mean, in comedy, okay, you’re just going for an easy laugh with a joke. It doesn’t necessarily mean that there is wrought. But if you’re writing a drama and you have a scene where someone has tripped and fallen and the other person is trying to drag them away and they say, “No. Leave me. You go on.” You just…you blew it. There’s a big problem there.

**John:** Some of these are transitional phrases that they are trying to, like — the scene was going in this direction and then it has to go in a different direction. Like someone has to start some exposition or someone has to do something different. The energy of the scene has to change. And they are just space killers; you have to find a way to not do them, because in real world situations you wouldn’t say that, they wouldn’t be there. You would just actually start the next thing.

**Craig:** Yeah. This kind of stuff actually came in very handy when I was writing spoof movies, because the spoof characters almost only speak in these things. I used to talk about it with Anna Faris, because we were trying to figure out how it was that these sort of lines worked in spoof but not in anything else; in anything else they were horrible. And we both realized that in spoof, characters have no subtext whatsoever; they simply say what’s on their mind. [laughs] They’re just very, very stupid people.

**John:** Yes.

**Craig:** And this is the way very, very stupid people talk. So don’t make your characters very, very stupid.

**John:** All of these lines sort of sound like a Tracy Jordan movie, from 30 Rock. So when they do the cutaways to one of the movies that Tracy has made, these are all lines that he would have said in one of his movies.

**Craig:** Exactly, like, “I’ve gotta get me one of these.” It’s just so…You’re just not trying at that point. And I don’t like using the word “lazy” for writing, because I feel like writing is super hard and there’s nothing lazy about it, but in that case it’s actually not hard to write that line. It was written for you, chewed up, and spat out 100 times. So now you’re just sort of retyping something. It’s not very inventive.

**John:** One of these lines, the first time I heard it was in Rawson Thurber’s script and his movie for Dodgeball, which was, “I just threw up in my mouth a little bit.” And maybe it was originally Rawson, or maybe it had been there for a long time and I just happened to never hear it, but Christine Taylor says it to Ben Stiller, and it actually works really well in the scene. But that was the first time I heard it. I don’t know if that that was the origin of it.

**Craig:** It long predates Dodgeball. When it showed up in Dodgeball it was kind of just sort of… — He was still in the safe zone, but it was already tilting into clamage. And the thing about those kinds of lines is that once they appear in something big and prominent and they use that in the ads, it’s done. Like, nobody else should go near it. So, you might say, “Oh man, you know, I came up with that line, I put it in a show and no one saw the show and then three years later I see it pop up in an ad for a movie, and now everyone thinks the movie came up with it.”

Well, you know, suck it up. That’s part of comedy and we’re all in this together. But, once it does show up in something like that, one cannot go near it again. It is done.

**John:** Done.

**Craig:** And yet I will still see it. You know, my daughter watches the Disney Channel sitcoms and they’re just clam festivals.

**John:** Yeah. It’s a clambake.

**Craig:** It’s a clambake like you have no idea. Yeah.

**John:** So here’s how I would use the “I just threw up in my mouth a little bit.” In a situation where that could be a line, why don’t you just have the character kind of throw up in their mouth and literally have to spit out the vomit? It’s funny again.

**Craig:** Right. Like I actually threw up in mouth.

**John:** So they don’t even have to say anything because we sort of know what it is. And so just, like, have them upchuck a little bit and have to put it in a little towel and it would be great.

**Craig:** Yeah.

**John:** Or in their hand, because bodily fluids in hands is funny.

**Craig:** Or like a man kisses a woman in a bar and she says, “I think I threw up in your mouth a little.” [laughs]

**John:** [laughs] That’s funnier.

**Craig:** However you need to put something on it.

**John:** Yeah. I think if he says, “I think you just threw up in my mouth a little.”

**Craig:** “Did you just throw up in my mouth a little?” [laughs] It could be a question.

**John:** [laughs] Yeah.

**Craig:** “I think I might have thrown up in your mouth a little.” Yeah. Hmm.

**John:** Hmm. It’s good. See, we’re writing here.

We have some questions, so let’s get to some questions, which is I think one of the things I’ve enjoyed most about doing this podcast over the last two years, answering some questions and getting some multiple opinions here.

So the question is from Jared in Weston, Connecticut. He asks, “What is the process of selling a spec script as a completely new writer? Maybe you could use Go as an example. Do you have to have representation in order to sell a spec? Who buys a spec — producers or studios? I totally understand if this is one of those cringe-worthy ‘how do I get an agent’ questions, but I’d really love to hear your insight into the process.”

So, yeah, I think some 101 questions are valid every once and awhile.

**Craig:** It’s a good question.

**John:** Good question. A spec is a script — just so we’ll define terms here from the start — a spec is a script that you wrote yourself that is not based on anything. It’s just you sat down at your computer and you wrote a spec script. This was 100 percent your idea and something you did. And you own it, completely, so no one owns any other part of it.

Generally, if it’s not a movie you’re going to make yourself but you’re trying to sell it to someone else to make it, that would go out into the world with an agent or a manager or someone else who is representing you and the script to buyers. Those buyers could be producers. Those buyers could be big studios. They could be some sort of in between production entity. But generally it’s pretty rare, I think, for a production company to find your script and directly buy it without some other intermediary force. Craig, you can correct me if you disagree.

**Craig:** No. I think that that’s absolutely correct and it’s going to be the studio that buys it, not a producer. Producers attach themselves to specs. Producers aren’t really employers. This is a hard concept for people to wrap their minds around when they haven’t been exposed to the very strange business of studios versus producers.

Producers basically are just hired guns by the studio to shepherd projects, but they don’t actually pay you. They don’t buy stuff. They may option things. I mean, occasionally they buy things if they have a discretionary fund, which is a pool of development money that the producer has access to and can use freely.

Still, even in those cases the money is from the studio. But you were right on.

**John:** So, the advantage of writing a spec script is that obviously you can just write it and it’s free and clear and it’s yours and you can do whatever you want with it. Maybe you will sell that script to somebody, and that script will not become a movie. Most cases, no one will buy that script. That doesn’t mean it’s not incredibly valuable.

So the first script I wrote was this romantic tragedy set in Boulder, Colorado. It never sold. God bless it, it should never have sold because it really is not a movie, but people read it because they could read it. And they liked it enough that it got me my first jobs, my first assignments.

Go was the first spec script that I sold, and that sold to a tiny little production company. But it was sent around all over town, so at that point I had an agent who sent it to all the studios who said, “We love the writing. We can’t make this movie.” And a little tiny company said yes and that was the start of that.

**Craig:** And that’s the case now more than ever. There once was a burgeoning spec market, not so much anymore. Occasionally still people sell specs. But more often than not the specs today are calling cards for people to advertise their talent and their abilities.

**John:** And so there are weird exceptions. Like Amazon Studios will buy things that has no agent or manager or sort of anybody representing it. But Amazon Studios is a weird, sort of special case that I wouldn’t strongly recommend to anybody.

**Craig:** Agreed.

**John:** A question from Armin in Tehran, Iran. We have a listener in Tehran.

**Craig:** Cool!

**John:** How great is the world?

**Craig:** The world is pretty great. Iran is not so great. I just read that they are now banning women from various classes in their universities. Not cool.

**John:** Not cool at all.

**Craig:** But, you know, the other fascinating thing about Iran, and we’ll get to his question in a second, is that did you know that there are no gay people in Iran?

**John:** That’s fascinating.

**Craig:** Yeah. Mahmoud Ahmadinejad assures us that there are no gay people in Iran. [laughs] It’s the one place in the world where they just don’t grow.

**John:** Yeah. Wow. They figured something out!

**Craig:** Cool guy. So, what’s the question? [laughs]

**John:** [laughs] “I’m a screenwriter and I wrote some screenplays that I think have a chance to sell. Would you please help me know about ways to save my rights? As you know, unfortunately Iran isn’t under copyright law or a WTO copyright registration. So if I register my works at the WGA, how can I present them? I have a trustful friend in the USA, so is it possible to ship to him? If yes, what are the legal stages? Thanks for your attention.”

**Craig:** Oh boy. Wow.

**John:** So, way outside of our realm of experience. First off, I don’t know this to be true, so I’m taking him at his word that Iran actually doesn’t abide by copyright law. But that just kind of throws a wrench in everything.

**Craig:** It does. I mean, it may be true. There is copyright law which is country to country. And then there is essentially the Berne Convention, which is a kind of overarching regulator of copyright throughout the world, but even for instance the United States doesn’t subscribe to all the parts of the Berne Convention.

For instance, droit moral and so forth, we have work-for-hire, Europe doesn’t. Our copyright here in the United States is actually enshrined in the Constitution itself. Most people don’t know that. There’s part of the constitution that just talks about copyright. I have no idea what the situation is in Iran. I’m going to take his word for it that they don’t have any copyright protection, which seems odd to me.

And if that is the case and this person was trying to sell screenplays not in Iran, which I would imagine is the case given the situation there, then what I would do is probably send the script to, I guess, to the United States Copyright Office. Because the truth is anybody anywhere can register something with the Copyright Office in the United States. I don’t think you need to be a citizen, per se. And you would get the protections of that copyright where it applies, mainly the United States. But other people would respect it as well.

**John:** Yeah. My first line of investigation would be to figure out — there are Iranian filmmakers, and so obviously they are doing something. But, look at Iranian novelists or sort of anyone who is publishing outside of Iran and try to figure out how they’re doing what they’re doing, because they must have some copyright protection in places outside of Iran. So that would probably the first and best way to pursue — whatever they’re doing is probably the right thing to do.

US Copyright Office, certainly if a non-citizen can do that, that’s a great idea, too. Worse comes to worst, I think there might also be a way that if he has this trusted American friend — and again, this is just speculation, because it could be a work-for-hire in which the copyright vests in the employer — you could do something where potentially the person is buying it here for a nominal fee and registering that as being the owner — registering himself as being the owner of this copyrighted material.

**Craig:** You don’t actually need to do work-for-hire for that. You can transfer copyrights. The other thing is, the simplest thing if you wanted to go that route would simply be to send the script to your friend and have them register it as their own copyrighted work.

However, the purpose of copyright and all of this ultimately is to properly credit authorship. And the person who is writing the question is the author, not his friend. I have to believe somewhat that that can be protected. But, you know, this is one we’ll have to do a little research on and come back to, because that’s tricky. And I feel like I need more facts before I can answer properly.

**John:** Yeah. But I’m just excited that somebody in Iran is listening to our podcast.

**Craig:** That is fantastic, by the way. And we have here in Los Angeles we have a very large, very significant Persian community. I have a lot of Persian friends. And I am a fan of the people of Iran. Not so much the government, but the people.

**John:** We all hope for a very positive outcome in the decade to come for Iran.

**Craig:** Yes.

**John:** A question about following up after a meeting. So, Bin Lee writes in to ask, “By dumb luck I ran into an established Hollywood writer at an airport in Cleveland this weekend. He was very nice and gave me his email since we ran out of business cards.” We had an earlier conversation about business cards.

“The next day I sent him an email reminding him who I was and it was nice to meet him. I also asked if he was free to meet up for lunch so I could pick his brain on some topics. Was it too forward of me to ask him to meet for lunch? I know there’s a fine line between friendly and too aggressive. I’m sure he’s super busy and I’m a small fish, but let’s say he doesn’t reply to my email. How long should I wait before I try to email him again? Two weeks? One month?”

**Craig:** Well, there’s nothing wrong with asking somebody to lunch. There’s nothing particularly too forward about that. It’s only forward to presume that they must have lunch with you. And he doesn’t have to have lunch with you and he may not want to, because like you said he’s busy. I think you could always shoot him another one in a month I think is fair and just say, “Hey, doesn’t have to be lunch, by the way, maybe just coffee. Or maybe we just get on the phone for 20 minutes. I just have some questions.”

I think you should err on the side of making it as easy as possible for this person to help you.

**John:** I would agree. I would also… — The huge advantage to me for coffee is that coffee has a much more limited time commitment implicit. And so I will tend to do coffee with people who are sort of in the situation where he’s a friend of a friend who, you know, I don’t know whether this is going to be a good time or a not so good time. Coffee could be 15 minutes. It could be an hour. But it’s much less of a commitment, so that’s a helpful thing for me.

In terms of following up, I think it’s a great use of the email, that’s good initiative. If after a week you heard nothing, maybe lob another, but after two contacts and you hear nothing, let it be done, because it’s not something that’s going to… — More follow up isn’t going to make that better.

**Craig:** I totally agree. Two emails is plenty. The lack of response should be presumed to be a “no,” and while it may seem rude, and it technically is rude, the truth is I get a lot of emails from people. I don’t even know how some of them get my email. And what happens is I find myself suddenly spending an hour helping people with stuff. And I don’t have an hour sometimes.

Sometimes I have the hour, I just don’t want to do it. I just want to lie down.

**John:** Yeah, that’s fair.

Brendan writes, “My writing partner and I have recently collaborated with a director on an idea he had for a movie. It was made clear at the beginning that the director wanted a shared ‘Story by’ credit and some form of compensation since the pitch was based on his original idea. We agreed in principle to this — no contracts yet — and used the WGA residual formula to determine the percentage of any initial sale. Therefore, one-half of a ‘Story by’ credit is 12.5 percent. We then sold the pitch to a studio, and between our lawyers and studio business affairs no one can seem to come up with a clean way to execute what seems to be a standard type of situation. How does this not happen all the time? WGA says their jurisdiction begins at the written story treatment level and do not cover pitches. Any suggestions on how to proceed?”

**Craig:** Oh, boy. This sort of stuff happens all the time. The Writers Guild is correct. The problem is: What writers sell is written material; what producers sell are ideas. So, what I would suggest, since the director appears to have not written anything but rather tossed ideas around with you, gave you an idea which you then took and started to write, what I would suggest is that you take the amount of money that the studio is willing to pay you — let’s just say, we’ll call it $100,000. You take 87.5 percent of that. So you say to the studio reduce the amount you would give me for the writing by 12.5 percent. You are the only writer employed. Take that remaining money, whatever I just said, $12,500, give that to the director and pay him under a producing deal.

**John:** But here’s the problem: Ultimately if the movie gets made there’s nothing guaranteeing that director a ‘Story by’ credit when it comes to determining credits.

**Craig:** He shouldn’t have a “Story by” credit. Here’s the deal: He didn’t write it. And sometimes people get really cranky about this because they feel like, “Well but it was my idea and I talked it out and I told them what to do.” Yeah, but you didn’t write it. Trust me, pal, and I’m being mean to this guy, it’s not fair — I’ll be nice to him. Trust me, friend, [laughs], the reason that you told that thing to him and then had him write it is because writing is annoying and/or hard.

There is actually value in the writing itself. And that’s what screen credit is for. Writing credit is for written words on a page, not for ideas or thoughts. If you want to open up the notion that credit be for ideas and thoughts, everybody gets credit. You’re not the only one who is going to be asking for story credit. Why won’t the producer, the executives, the actors, everybody — the writing credit is a really specific thing. Words fixed on a page literary material.

**John:** So, I basically agree. I think Craig’s solution is probably the best solution for the situation as it exists right now. Let’s play time machine, though. If you decided at the start that this director wanted “Story by” credit, shared “Story by” credit, what you should have probably done is worked up the pitch in a written form with him involved in writing up the pitch so that he was one of the people who helped write the pitch for it. And therefore there was some literary material that you could register and say this was the underlying material behind this so that it was natural that he was going to be getting his percentage down the road, that this “Story by” credit was going to be shared between the three of you.

**Craig:** And if my solution doesn’t fly for any number of reasons, I guess the only remaining thing to do would be to resubmit the original treatment as written-by the two of you. And then the problem is solved.

**John:** Yeah.

**Craig:** It may not be true, though; in fact, it isn’t true. So the Writers Guild at that point may do something called a participating writer investigation or a pre-arbitration to make sure that you weren’t strong-armed into this sort of thing.

**John:** And it doesn’t sound like he was strong-armed. It sounds like from the very start this was the intention. And we don’t know all the facts on what this collaboration was. And maybe there were zillions of emails back and forth, and so there is writing happening on what this project was way back when. So, we’ll see.

**Craig:** Yeah.

**John:** A question from Josh. Josh writes, “Scriptnotes has introduced me to podcasts and now I’m hungry for more. John has mentioned a few times listening to podcasts while doing dishes, so I’m wondering what other podcasts do you recommend for your listeners, either screenwriting related if there are others, or otherwise?”

So, Craig, if I recall correctly you don’t listen to any podcasts at all?

**Craig:** No. I do not listen to podcasts. I’m not a very auditory — auditorily inclined learner. I’m much more visual. So, I tend to read everything and listen to very little, except for music.

**John:** So I listen to a lot of podcasts. So, the four or five that I picked out, which I think are fantastic, which won’t be to everyone’s taste, but I recommend them so you should try them in iTunes. First is a comedy podcast called Throwing Shade with Erin Gibson and Bryan Safi. It’s absolutely filthy and it’s great fun.

Build & Analyze is a Mac iOS development centered — really iOS development centered podcast with Marco Arment that is fantastic, and Dave Benjamin.

John Gruber’s podcast I was on a couple months ago. He’s great. And so he’s been doing a podcast for quite a long time. He describes it as being the director’s commentary for Daring Fireball, his website, which is very popular and is good.

And then for all my political stuff I really love the Slate Political Gabfest, which is a weekly podcast which has three very smart people from Slate talking about three issues that are on the national stage. And so listening through the Republican primaries and sort of getting into the actual campaign season, it’s been a great source of both information and commentary about that.

For screenwriting, the only other one that I listen to with some regularity is the Nerdist Writer’s Podcast, which is actually fantastic. And so it’s a TV-focused podcast that talks to showrunners and other television writers about the craft, and it tends to be more of a roundtable setting, and it’s really great. And so we’ve talked about doing some sort of shared podcast with them at some point which hopefully in this next year will get to happen.

**Craig:** Oh, that sounds kind of cool.

**John:** Yeah. Our last question of the day is about finishing, so I thought this appropriate. Josh in LA writes, “I have a problem. And that problem is finishing a script. It may sound pathetic, but for me it’s very real and very worrisome. I have what I think are great ideas. I understand mechanics of writing and all that, but I find that during the process I either begin to dislike the idea or I’ll come up with some reason why it’s not the right script to be writing, and once that happens I’m zapped of all motivation.

“I produce a lot of material. I think it’s good material, but I seem to struggle with crossing the finish line. I have attention deficit disorder and I don’t take medication for it, which may have something to do with impatience or lack of focus, but outside of that I’m curious if this is a common problem and would be grateful to hear you or Craig give advice.”

**Craig:** I’m sorry. I just love “I have attention deficit disorder but I don’t take medication for it.” You know, maybe you do have attention deficit disorder; I don’t know. That has nothing to do with why you can’t finish your screenplay.

**John:** Not a bit.

**Craig:** If you enough attention to write 70 pages, you have enough attention to write 110 pages. The problem that you’re experiencing is very common and I would argue almost always is the result of poor planning before you start it. There is no reason that you shouldn’t know precisely what the ending of your movie is before you start writing it.

The beginning and the ending are married to each other. And the fun of writing the movie is moving from one to the other in an interesting way, taking a character from one to the other in an interesting way. So, if you don’t know how the movie ends or you lose sight of what the movie’s ending should be, it’s because you just didn’t start right. So I would suggest if you are not already doing this, you — specifically you — should outline your movie completely.

You should be able to describe the movie to somebody as if you just saw it scene by scene before you write “Fade In.”

**John:** A lot of what he’s facing I think is also the-grass-is-always-greener problem. When you are in the middle of a script, you see all the problems with your script because you’re facing them every day. And so every time you sit down to work on it, you’re bombarded by everything that’s not working right in your script.

And so there’s always going to be that shiny other idea that’s like, “Oh, well that would be a better thing for me to write because that’s all new.” It’s the pretty girl sitting over there that doesn’t have all the baggage of the girl who’s sitting in front of you.

So you are fascinated by that other thing because you are not aware of its problems. And so of course that other idea is going to look better. And you want to go off and write that one instead of the one you’re in right now.

You’ve got to finish. And what I think a lot of people don’t understand about screenwriting when they first start to work in the form is 120 pages is really long. I mean, it’s the longest thing that most people ever have to write. And it can be a challenge to get through it all. And so with good planning you’ll hopefully be able to know what the next thing is. When you encounter that second act malaise, which really I think encounter that moment of like, “Oh, I’m stuck in the middle of this and it doesn’t seem like it will ever end,” jump forward and write something else that is exciting for you to write. Write those things at the end. Write those things that got you excited about it.

And I always forget which writer first told me about this idea, but it’s a really good idea that I’ve never actually implemented but I sort of should. Right when you first get excited to write a project, when you first set out, this woman, she writes a letter to herself about how much she loves this project and why she’s writing it. She writes it. She seals it in an envelope. And then when she hits that moment where she can’t do anymore with it, she rips open the envelope and reads that letter and that helps her get through the draft.

**Craig:** Aw. She gives herself a hug.

**John:** She gives herself a big hug.

**Craig:** Aw!

**John:** Which is nice. So, I say, Josh, give yourself a big hug. Know that really every script sort of feels like it’s never going to be finished. I mean, this thing I just turned, it wasn’t that I was even struggling with the work — I wasn’t struggling with any scene or any one moment of it. I was just like, “I can never get this thing finished.” But then I got it finished and it’s mostly just sitting down, or in my case standing up, and doing the work.

**Craig:** Yeah. You certainly can’t let despair stop you. If you let despair stop you — if everyone who wrote screenplays let despair stop them, your multiplex would be empty.

**John:** Yup. And with that, I want to talk about One Cool Things. Do you have a One Cool Thing this week?

**Craig:** I do have a Cool Thing this week.

**John:** I hope ours isn’t the same thing. I worry that it might be the same thing.

**Craig:** There’s not a chance.

**John:** Okay, good.

**Craig:** You go first.

**John:** My one cool thing is a book trailer for a book by Derek Haas, who is a friend of both of ours.

**Craig:** Oh, yeah, I liked his book trailer.

**John:** It’s a good book trailer. So, Derek Haas is a very prolific screenwriter and now a TV writer, and he has a new show, Chicago Fire, on NBC which was advertised incessantly during the Olympics. I felt like the Olympics were on fire how often they were showing that commercial. He writes with a writing partner, Michael Brandt, but he also by himself writes books.

And I don’t know how he does it. It’s some sort of drug that lets him just create a tremendous amount of words. But he has a new book coming out this fall called The Right Hand. And there is a trailer for the book which is actually really good. They did a great job with it.

And I’m not sure I completely believe in trailers for books, but this kind of sells me on it, because it feels like this is a spy novel and I see sort of why a person might see this and think, “Wow, I’d see that movie. Since the movie doesn’t exist yet I’ll read this book.”

**Craig:** Excellent. Yeah. It’s very cool. And Derek is a good guy. I just, in fact, came back from lunch with him.

**John:** Ah.

**Craig:** He’s my friend. I have a Cool Thing this week that I don’t understand. And I think one of the great things about this podcast is that while ostensibly it’s about us helping people, I feel like we have this amazing cohort of listeners out there who are really smart. And I notice in the comments and tweets and things, sometimes they’re just a step ahead of us on some things. And I feel like somebody, one of our listeners, is going to be able to explain to me, because I’m so fascinated by it.

So there was this really cool article in Gizmodo, a website I love, and it was titled The Algorithm that Controls Your Life. Did you read this, John?

**John:** I did not.

**Craig:** It’s really cool. Okay. So an algorithm is basically a decision-making chart. It’s just a way of approaching how to make decisions and determine outcomes. And so, for instance, “A fund manager,” I’m reading from the article, “a fund manager might want to arrange a portfolio optimally to balance risk and expected return over a range of stocks. Or, a railway timetabler wants to decide how to best roster staff for trains. Or a factory manager tries to work out how to juggle finite machine resources. This is the job of the algorithm.”

There is one algorithm that emerged in the ’40s from the work of a mathematician here in the United States named George Dantzig. And his job back then was to increase the logistical efficiency of the US Air Force, a pretty mundane kind of problem. But what he came up with was an algorithm that is represented by something called a polytope; it’s basically a chart — a pathway decision chart. And it’s this kooky looking sort of — it looks like a weird gem almost. And his particular algorithm was called the simplex algorithm.

And it turns out that the simplex algorithm is the most useful algorithm of all. And it is used in everything — search engines, how food gets to the market, everything. One academic quoted in the article says, “Tens or hundreds of thousands of calls of the simplex method are made every minute.”

So, to you out there: What is this? [laughs] I need to know. I need you to explain the simplex algorithm and I need to understand how an algorithm is represented by a shape and why this one is so powerful.

**John:** That’s great. That’s a great call to action, because I think we have some very smart listeners who will be able to describe it in terms that are not necessarily layman, but smart-but-not-maybe-gear-heady people can understand. That would be great.

**Craig:** Yeah. I just love that there’s some dude in the ’40s who came up with a shape and the shape is controlling our lives. [laughs] It’s so cool. And I need to understand how. So thank you. Thank you, unnamed person.

**John:** I find all these kinds of optimization and sort of, you know, trying to look at how decisions are made fascinating. So, economics, I loved taking the classes but none of it really stuck. Like supply and demand stuck, but the bigger implications of it always sort of went over my head. And so I like that people understand it. I guess I trust that people understand it. Sometimes I have moments of doubt that where I think that people are sort of just making stuff up. But it’s neat.

**Craig:** The fun thing about economics — and I’m with you by the way, exactly with you; I understand basic concepts but then once they leap past those I’m gone — but economics is one of the few areas of academic study where no one seems to agree at all. It’s almost to the point where it’s useless. I mean, there’s a predominance of people who believe that something is true in terms of medicine or biology or physics.

I mean, most physicists believe that the Higgs boson was real. Some didn’t. But most did. Economics, it just seems like, well, you’ve got Vienna over here and you’ve got the other one over there. [laughs] Keynes. And they just don’t agree at all. And they argue all the time.

**John:** Well the trouble becomes is you’re trying to control — it all looks really pretty on a chart, but in the real world you are controlling for so many variables; you really can’t say whether that had this impact or had this impact. So, did raising that marginal tax rate make this change, or did it have all of these other manifestations in ways that you can’t have anticipated? So, that’s where I get confused.

And so it’s always fun to talk about, “oh, guns and butter,” but then when you actually really drill down and get into more specifics it’s not as simple or fun.

**Craig:** I feel like psychology is a bit like that, too. Psychology is so open-ended. It can almost account for any outcome. Any one theory can account for any outcome which makes all of it useless.

**John:** Yeah.

**Craig:** But not the simplex algorithm. That will someday tell us what to do. I think it already is, actually.

**John:** Yeah. Right now. It has told us that it is time to end this podcast.

**Craig:** Mm-hmm.

**John August:** Hello and welcome. My name is John August.

**Craig Mazin:** My name is Craig Mazin.

**John:** And this is Scriptnotes, a podcast about screenwriting and things that are interesting to screenwriters.

Craig, can you feel it? It’s that time of year again.

**Craig:** It is my favorite time of year, John. My favorite time.

**John:** Because it’s WGA election season again.

**Craig:** Oh, so good.

**John:** Every year we get to pick new candidates for — not really new candidates — we get to pick new members to be on the Board of Directors for the Writers Guild.

**Craig:** We get to.

**John:** We get to. And for a very small percentage of our listenership are extraordinarily interested in it, and the rest of our listenership could kind of give a rat’s ass. But, I do want to talk about it because it’s important. And so it’s one of the things we’ll talk about today on the podcast.

And we’ll talk about actually a thing that is maybe a little bit more important and factors into more people’s lives, which is how to not be fat.

**Craig:** How to not be fat. For writers.

**John:** For writers, yeah. Really kind of for anybody. You can choose to not be fat and be an accountant, or an editor, or there’s many job which you can choose to not be fat. A sumo wrestler? This is not the podcast for you.

**Craig:** Right. That — we’ll be doing a future podcast called How to Be Fat.

**John:** And that’s just for sumo wrestlers. And we’ll give you fair warning that it’s not going to be for everyone.

**Craig:** Right.

**John:** Just like the career of screenwriting isn’t for everyone, the career of sumo wrestling is not for everyone. Did you ever see — there was a kid who really aspired to be a sumo wrestler, and he just wasn’t actually tall enough. And so he got essentially a silicon boob implant on the top of his head to give him enough height.

**Craig:** What?!

**John:** So, I swear this is real and I’ll try to find a link for it and put it in the show notes. This kid, he really wanted to be a sumo wrestler and he wasn’t tall enough. And so essentially they put in one of those expandable boob implants at the top of his head, like under the skin, between the skull and his hair line to raise up his head so he would be technically tall enough to compete in sumo.

**Craig:** But then unfortunately once the operation was complete he just spent all day feeling the top of his head.

**John:** Yeah. The things people will do. I mean, that’s crazy, but it’s crazier than like what many women in the 50’s will do to their faces.

**Craig:** Actually, I disagree. It is, in fact, crazier. He’s put a tit on the top of his head in order to be a sumo wrestler. First of all, sumo wrestling is a ridiculous sport. I know. I know, I’m going to get it from our sumo listening… — It’s really sumo wrestling is a legacy sport. It’s really done now I think mostly just to celebrate culture and tradition. It’s not actually really a good sport that anybody outside of Japan watches with any regularity.

I guess you could argue that — no, because baseball — people love baseball in Japan, and the Dominican Republic. It’s just a legacy sport. And this kid didn’t qualify for height, and this is a body size sport. Adding the head tit is not going to make him any better at sumo wrestling. He’s really just gaming the rules and he’s gonna get his ass kicked, I presume, because he’s just not tall enough.

And, also, he has a boob on his head which is insane. And I presume that, now that boob is there, that he’s going to spend the rest of his life as Tit Head.

**John:** Yeah. He could take the boob out if he needed to. He could have a head-breast reduction surgery.

**Craig:** It’s ridiculous. I mean, don’t get me wrong: I think that what a lot of women in their 50’s, and by the way, let’s be equal opportunity about this — men…

**John:** Oh yeah, do some crazy things too.

**Craig:** There’s a guy who’s reporting on the Olympics and my wife keeps…she insists I have to come in and see him every time because he’s so Botoxed up. But sometimes when they Botox you I guess they can’t hit the sides, they just get the front of your forehead. So he’s got this preternaturally smooth immovable forehead but every time he does move where his forehead would move, the sides wrinkle up. It’s kind of like Saran Wrap does when it’s over a nice chicken breast and then you squish it. It’s horrifying. Horrifying.

What are these people doing?

**John:** Which people? The people who are getting the Botox injections?

**Craig:** Right. I know what they’re doing. But why?

**John:** Because they see sometimes it actually works amazingly well and for some people it is fantastic. And god bless them if they want to look their best. But for other people it is just horrifying and they have some sort of mirror disease where they’re not actually seeing what’s in front of them.

**Craig:** Dysmorphia.

**John:** It’s dysmorphia, in fact.

**Craig:** Dysmorphia. But here’s my point: I grant you that in some limited cases with limited amounts of treatment it can make you look better, objectively better. But, over time that’s a losing battle. There is a tipping point for all human beings where all it does is make you look freaky. And at some point I suspect these people just don’t understand that they have to stop now. And it must be really hard because if you’re the kind of person that’s not willing to put up with a few wrinkles, you’re not going to be able to put up with looking like the prune that we all become.

**John:** The most impressive, I don’t know if it was plastic surgery or other work I ever saw done is Jaclyn Smith, who is, you know, from the original Charlie’s Angels. She’s also in the Charlie’s Angels sequel.

And so I met her and I’m like, oh my…I’d heard about…I’m like, “Oh my god, you are stunningly beautiful and you are a woman of quite a significant age.” And you can’t, I mean, literally her face was just perfect. But then you shake her hand and you’re like, “Oh, this is an older woman’s hand. This is the hand of the actual person you are.”

**Craig:** Yeah.

**John:** They can’t do anything for your hands. That’s why you can wear gloves.

**Craig:** And now you’re a glove-wearing freak. [laughs] You know, I remember Bill Maher years ago had a great thing — he was talking about how everybody would always say Sophia Loren is still the sexiest woman on the planet. And he’s like, “No she’s not. She’s a grandma. You don’t French kiss grandma. Let’s stop pretending that this 70 year old woman is the sexiest woman on the planet.”

There’s a whole reason that sexy is about young. It’s not about being offensive to old people. It’s because you’re not procreative anymore. Sexuality is tied to procreation. I mean, that’s why it’s there. Granted, in some cases orientation makes that impossible, but ultimately that’s why it exists in the first place. And we all stop being procreative after a certain age, so why would an 80 year old person be sexy, or a 60 year old person? They’re not really sexy.

And anybody who tells you that 60 year olds are sexy, they’re just being nice.

**John:** [laughs] Maybe so.

**Craig:** Ah, look, you see? This is where…so Pam Ribon, a good writer and a friend of ours, friend of the podcast, did a whole thing about the podcast the other day about why women aren’t sending in as many things and are they really less interested. And she, [laughs], she described it to us as you’re the nice, nurturing one and I was the rich, cranky guy.

**John:** Yeah, I don’t actually want to challenge you too badly on stuff, but there’s times where, yeah…

**Craig:** You think so?

**John:** …I disagree with you.

**Craig:** Well, first of all, can I just say, I know we’re wildly off-track now; we’re turning into the Howard Stern Show. But why am I the rich cranky guy and you’re the nurturing guy, but you’re not the rich nurturing guy? You’re rich.

**John:** Oh, that’s an interesting point of view. Nurturing I get; I do have this tendency to sort of look for the bright side of situations and to help people along. And I will humor people with their idiotic questions sometimes. Rich is an interesting distinction.

**Craig:** Yeah, like I’m the bad banker from It’s a Wonderful Life or something like that, you know. But then she called me out for referring to one of our submissions, and it was submitted by a woman, as being “cute.” And that was sort of, in her mind, it was a bit pejorative when…

**John:** See, I don’t think “cute” is pejorative at all.

**Craig:** I don’t either.

**John:** Like Frankenweenie is cute. My upcoming movie Frankenweenie is cute.

**Craig:** It is cute. Those ads are really cute. Exactly. Yeah. I don’t think so. And then also women call guys “cute” when they like them.

**John:** Totally. And I was just having a conversation with Mike Su, who is a video game developer for iPhone and iOS devices. And we were talking about like the best selling iOS games. And I pointed out, like, “They’re all cute.” The winning titles — they’re cute. They have to have something cute. And they need to have sort of bubbly heads and big eyes and those are the ones that are top sellers.

**Craig:** No question.

**John:** There’s nothing wrong with cute.

**Craig:** So that’s my response. That’s my response. That’s my cranky response.

**John:** Let’s do some follow up.

**Craig:** Yeah.

**John:** Last week we talked about my concern that when you read reviews of movies, the screenwriter’s name seems to only be mentioned when it’s a negative review. And if it’s a positive review you’re not even going to her the screenwriter’s name.

**Craig:** Right.

**John:** And so I asked if anybody who is like a grad student in statistics, or is pursuing that, wanted to actually do a study.

**Craig:** You’re not going to tell me that somebody actually — somebody actually did this?

**John:** Someone stepped up.

**Craig:** You’re kidding me. Already?

**John:** Already. So, Tim from Hollywood stepped up. And so he’s volunteered to do sort of a small pilot study. So he’s going to do 50 recent movies, looking through their Rotten Tomatoes, just to see if there’s something there.

**Craig:** Great.

**John:** So it’s just a test run to see if there’s something interesting worth studying there. If the results come back that there’s probably nothing there, yeah.

**Craig:** Hey, that is, you know, we have good listeners.

**John:** We have great listeners. We have the best listeners.

**Craig:** Really. Thank you. That’s awesome.

**John:** We have 99,000 brilliant listeners. And 1,000 people we could do without. But most, the people who are listening right now, they’re the best listeners in the world.

**Craig:** The best.

**John:** Mark writes in. “I listen to the podcast every week.” Thank you, Mark. “Ever since Craig mentioned his wacky electronic cigarette a few podcasts back I’ve noticed an odd sound that, upon closer listening, sounds a lot like someone inhaling a fake cigarette. It is telling that the sound always occurs when you, John, is talking, not Craig.

“Exhibits A through D in this week’s podcast: At 34:37 there’s a long inhaling sound followed by Craig’s ‘Yeah,’ which sounds like a veiled, gauzy, non-carcinogenic exhaled water vapor. **Craig:** [laughs] Now last week, if you all recall, I was desperately tired. And I listened back to the podcast, [laughs], and I sounded like a different person. I was really mellow. Not at all rich and cranky, which is not like me. And, yeah, I was definitely puffing on my electronic cigarette. Now I’m going to do it now, and so for our sleuthy listener who is bordering, frankly, on obsessive and scary, I’m going to — I’m going to provide you with the sound. And you may then match it up in your audio analysis booth, and make sure to say the words, “Wait. Stop. Enhance that.”

Okay, ready? [puffs] That was it.

**John:** Yeah, it’s pretty subtle.

**Craig:** Yeah, it’s very minor. Now if that was the sound you heard, in fact that was me attempting through the judicious use of an electronic cigarette to stay the F awake.

**John:** All right. That’s totally fair. But now, of course, I’m going to have Stuart sample that out and blow it up really big. And so whenever there’s an awkward pause, by that we’ll all know what’s really secretly going on.

**Craig:** When you say whenever there’s awkward pause you mean every time I finish saying something…

**John:** Yeah, before I get to a “Yeah.” When I’m thinking, like, “What will I say instead of ‘yeah?'” That’s what I’ll say.

**Craig:** Are you starting to hate me? [laughs]

**John:** Sort of. If this were a video podcast everyone would see that you have the electronic cigarette, but it’s in like one of those long cigarette holders, [laughs], so it’s extra fabulous that way.

**Craig:** That’s like, oh my god, Robot FDR.

**John:** Yeah. Or Miss Scarlet from Clue. That’s what I really picture you like.

**Craig:** Mm-hmm.

**John:** Matthew writes about last week’s podcast, “Craig seems to be using the words critic and reviewer interchangeably and I think he’s blurring a useful distinction. To my mind, reviewers write about films the week they come out and are designed to help filmgoers decide whether to see a particular movie. Critics when they’re writing focus more on creative decisions made by filmmakers and the effects they achieve.”

**Craig:** Yeah, that’s fair.

**John:** Craig, do you think that’s a useful distinction?

**Craig:** Yeah. That is fair. I was using them interchangeably and technically that person is correct. There’s a world of film studies, essentially. And so critic in that sense would be analogous to literally critic, which is not a book reviewer. That’s somebody that analyzes literary works, novels, and so forth.

So, yes, that is a fair point to make. I was using them interchangeably. I was talking about reviewers. People who write true film criticism really don’t exhibit any of the flaws that I notice in our reviewing industry.

**John:** Yeah. And I think I was blurring those two things together as well. The problem I would say is that I have hard time pointing to who are really the film critics left these days. Because what we think about as the places where you would find film criticism, at least in the newspapers, that’s really more reviewing. And so there are times you have the people who are also reviewing movies will do in-depth pieces about a movement or a genre or sort of things that are happening in film. And that really feels like criticism as opposed to reviewing a movie that comes out this week.

**Craig:** Yeah. Film criticism kind of had a heyday, I think, the sera-sera. Now if you actually look in real film criticism, it has fallen prey to what much of modern literary criticism has fallen prey to. It’s really steeped in identity politics and sort of — it’s all post-modern. And academia is still swooning from Foucault and Derrida. And one day it will figure out how to pull its head out of that quicksand pit and start writing in a way that’s relevant to people outside of academia, I suppose.

But if there are really good, relevant film critics out there that you find interesting to read, we’d love to hear about them.

**John:** Yeah, please write in.

Heather wrote in and she asked, “My blog was optioned by a cable network.” Congratulations Heather.

**Craig:** Cool.

**John:** “They bought certain stories they wanted to turn into a movie. I just received what I believe is called a script outline from the head of programming, and it is awful. When we were negotiating, he told me they wanted my voice, my vibe. Maybe he was just blowing smoke. My question is: would it be presumptuous and rude to offer to write a script outline free of charge for consideration? Or do I just accept that the material is now the network’s and cash the check when the project is complete?”

**Craig:** Hmm.

**John:** Tough call.

**Craig:** Yeah, well, there’s certainly nothing wrong with you trying to write something for them and saying, “Look, wouldn’t this be better?” But they’ve shown you their hand. This is what they want. If they’re giving it to you, maybe they’re giving it to you because they have to give it to you. I don’t know if you have any kind of approval written into your contract. I suspect you don’t. It’s not every day that somebody options or licenses a blog, and you probably didn’t have that much leverage I’m just guessing.

So, it may be that you’re just confronted with the age old lament of the novelist who licenses their book and then sees a terrible movie out of it.

**John:** I think she should go for it, because I think the money involved is probably pretty low. If you’re burning any bridges they’re not very big bridges, not very good bridges probably. So, I wouldn’t worry about them.

If this really was written by the network executive and not, like, they found a writer who did this, it may very well be that this person was trying to put together a pitch document to sort of show what they thought the movie was. And they’re not really a writer. And so maybe you really could step in and help that be the document that really shows what the potential of the movie is. So, I don’t think you’re risking much by trying. If it’s really that bad, step up.

**Craig:** That’s a better answer. I like your answer better. I agree.

**John:** Thanks. But we’ll keep yours just so people can compare and contrast.

**Craig:** Yeah. Well, I mean they should. They should see what a not-as-good answer sounds like.

**John:** Good. So, let’s move onto our main topics. This is the WGA election season. So every year we get to pick some new candidates for the Board of Directors. And every two years we also swap out our officers. Correct me when I make mistakes because you know this better than I do.

**Craig:** I shall.

**John:** But this is a cycle in which we’re not electing President and Secretary and Treasurer — that kind of stuff. We’re simply electing people to be on the Board of Directors. And it’s not as — I don’t want to say it’s not as crucial of an election, but it’s not as scary of an election, because this won’t be the people who are heading in to right away a new WGA contract.

**Craig:** Right.

**John:** So you want people who are going to be good stewards of the Guild, who are going to bring up the other topics that need to be talked about, but you don’t necessarily need your big guns on this one, because this is a building year rather than a fighting year.

**Craig:** Not exactly. I mean, the thing is even thought it’s what they call an “off election year,” the Board, there are 16 board members. And every year 8 of them are up for election. So, half of them are up for election along with the officers and half aren’t. This is one of those aren’t years, like you said, but they serve for two years. And two years from now I think our deal will be up and in advance, about a year in advance of our deal expiring nominating committees form, policy approach, all that stuff is formed.

I wish I could say that there’s any one year where it actually doesn’t matter. Every year actually kind of does matter if you’re looking at it in that context.

**John:** I would agree.

So this year I actually had the privilege of being on the nominating committee to help find these candidates. And so we met three different times and did interviews with all of these candidates, so I actually met I think all of these people who are running. And they’re all terrific.

So, I can talk a little bit about the nominating committee. I had the impression that we had to like, you know, give them our stamp of approval. It really was just a “you’re not a crazy person.” That’s basically our whole job was to make sure that no one who’s coming in the door was crazy, and hopefully get some really good people to run.

And so I took it upon myself to convince some people to come in and try, including Jordan Mechner and Barbara Turner, who are both great, great candidates. And I got to listen to what these people thought were concerns that the Guild to do a better job of addressing. We could help them sort of figure out how they might want to present themselves to WGA when they present in their candidate statement in the packet.

So, I thought we’d talk through just who the candidates are and give some quick impressions, if that sounds good to you.

**Craig:** Let’s do it.

**John:** I don’t want to pronounce her name wrong. It’s Katherine Fugate?

**Craig:** It’s Fugate. [pronounced Fu-jay]

**John:** Is it really Fu-jay?

**Craig:** Yeah. I think she’s, well, she’s from New Orleans and I think it’s some kind of Cajun/Frenchy kind of name.

**John:** Well I’m apologizing for mispronouncing her name. It’s so hard when it’s a name you’ve seen a zillion times written down but you’ve never had to say aloud.

**Craig:** Well you’d never get Fu-jay out of Fugate. Nobody would.

**John:** No one would. But I had one of those unpronounceable names, too, and it didn’t make it easier that everyone pronounced it wrong, too.

**Craig:** That’s true. That is true.

**John:** So Katherine is running again. David Goodman. Kathy Kiernan. David Shore. So these are all people who are currently serving on the board. They were elected in 2010 and they are running again. I have nothing particular to say about them.

**Craig:** Well, I’ve known Katherine for a long, long time. A very lovely, lovely woman. And I guess Pam is going to be angry with me, because I called her lovely. Sorry. She’s neither lovely nor cute. She’s formidable. [laughs] She’s a formidable, strong woman, and a screenwriter, and Katherine is very empathetic towards other writers as opposed to me. I’m, of course, cranky. She’s probably more…I mean, I hesitate to use really left and right; I mean, there’s generally people who are more moderate and want to try and seek a compromise to advance their goals. There are people that are a little more confrontational with the companies. She’s probably more confrontational than I am which is no surprise, most people are.

But she’s good. And she’s been around awhile. And I think sometimes just having served is valuable in and of itself. It means that you have a certain amount of understanding about what works and what doesn’t work. You’ve tried all the goofy crazy ideas. It’s a very common thing when people enter governance for the first time. They’re like, “Ugh, why don’t these idiots just do A, B, and C.” And then you get into the position and you realize, “Oh, because A is illegal, B is crazy, and C has been tried a million times and didn’t work.” There’s very few like, “Oh, why didn’t we think of that idea” when it comes to union governance. So it’s good to have people that have been around and have some institutional wisdom; so she’s one of them.

David Goodman, very nice guy. Family Guy writer, I think. He is really one of the few unreformed Patric Verrone guys left in there. He is all the way like what I consider to be part of a broken, proven-to-fail philosophy. So, I won’t be voting for him, but he’s a nice guy.

And who was the other one?

**John:** Kathy Kiernan and David Shore.

**Craig:** David Shore, I don’t know personally, but I hear great things about him. He is respected by almost everyone. And, I’m sorry, I missed the other name.

**John:** Kathy Kiernan.

**Craig:** Oh, Kathy Kiernan. So, Kathy Kiernan is actually a news writer. A lot of people don’t know that the Writers Guild West represents television and screenwriters, but it actually also represents a small amount of news writers, most of whom I think work for KCBS. And a small amount of news radio writers, I believe KNX. So we’re talking really a very small amount of people. Most news writers are represented by the Writers Guild America East. Most news radio people are represented by the East because that’s just the way it worked out.

Kathy’s very nice. Look, because we represent so few news radio writers, I’m always torn. Well, so much of what we do is about the 95% of the membership that we comprise, and not, I don’t know what it is, maybe like 50 news writers, but maybe fewer news radio writers. But, then again, it’s probably not a bad idea to have somebody like that there who is sort of representing the minority. So I think that’s a good thing.

**John:** That was really what I was looking at as we were interviewing these candidates, and I always have looked at it as I’ve gone through the book and sort of figured out who I was going to be voting for, is to try to get some balance between the different perspectives and what people are going to be able to bring to the table.

One of my big concerns is that feature screenwriters tend to be underrepresented in the Board. And feature screenwriter’s needs are in some ways unique and different than TV writers. It’s just the way, like daytime writer’s needs are unique. And so you want to make sure you have at least somebody on the Board who can bring that perspective, because if you don’t maybe that perspective is going to get overlooked altogether. And so finding the balance there is tricky. But I think we actually have some good candidates across the board for that.

There’s 8 other names here, so I don’t want to sort of go through each one of them because you won’t know a lot of these people.

**Craig:** I won’t.

**John:** I did want to single out Jordan Mechner who is a friend of mine who I asked to run. Jordan Mechner is best known as a video game designer. He did the original Prince of Persia. He did Karateka. I’ve worked with him as a screenwriter on a Fox pilot and we worked on Prince of Persia together. He’s fantastic.

And one of the reasons why I really wanted Jordan to run is that he comes from a background of actually owning intellectual property. And so as WGA members, the WGA represents employees. So we represent people who are hired to adapt things, or hired to create stuff for corporations. Jordan is from a world of creating stuff for himself and owning that intellectual property. And I think the way forward is going to be a balance between those entrepreneurial instincts of creating your own stuff, creating your comic books and graphic novels like he’s also done, and all that stuff that you own yourself that you are completely in control of, and working for other people.

And Jordan sort of balances that, and I think he brings some good perspective in sort of that part of the business.

**Craig:** Yeah. I think, having served on the Board, I will tell you that one of the things that happens pretty quickly is whatever you bring to it that you think qualifies you becomes subsumed a bit by what the tasks are that the union presents to you.

You may have a bunch of things that you think you’re good at or that you want to accomplish. The union says, “Yay, that’s great. But here’s what’s going on right now. And we need you to deal with this.” And so the most valuable trait is intelligence. And Jordan is very, very smart. So, on those grounds alone he’ll have my vote.

**John:** So here’s my advice to you: This next week you’ll be getting your packet if you’re a WGA member. If you’re not a WGA member you’ve probably fast-forwarded through this because this is not very interesting to you. But as you get your packet, I always like to look through and read the candidate’s statements. I kind of score them, because I’m a scorer. I like to rank them sort of one to ten. And then I look at sort of who’s endorsing them, who else I sort of agree with and sort of why they’re endorsing them, and make my decisions on that.

One of the things we talked about last year when we did this — god, that was a year ago, wasn’t it?

**Craig:** Yeah.

**John:** We’ve been doing this podcast a year. — Was that you don’t actually have to vote for 8 empty spots. You don’t have to vote for 8 people. So if there’s 6 people you really want to be in and you don’t really care about the other 2, you’re better off looking for 6.

**Craig:** That’s right. So that your sixth place guy doesn’t lose to your seventh place guy.

**John:** Yup.

**Craig:** That’s called bulleting your votes. You can vote for one person if you want.

**John:** Yeah. Do it. So, enough on that. This is sort of our big meaty topic and this came up a couple of weeks ago. We said, “We should do a podcast about that,” and let’s do a podcast about that, is how to not be fat. Because screenwriters as a career, as a group, as a cohort, tend to be larger members of the Hollywood community.

**Craig:** [laughs] You’ve already blown it by saying fat. So you don’t have to think the euphemisms.

**John:** Yeah, I think we’re fatter. Past euphemisms. But here’s the thing is: I don’t want to say that most screenwriters are fat, because I don’t think that’s really true. Compared to, like, average Midwestern Americans, we’re not fat.

Like, if you took a screenwriter and put him on a plane and he got off in Ohio, he’d be one of the thinner people there.

**Craig:** Well, for some of them, sure. I mean, in general really what I’ve noticed when I’m around other screenwriters is it’s not so much that we’re an obese lot. I mean, this isn’t like going to a Walmart in Mississippi. It’s that we’re out of shape. We’re out of shape. Some of us are very fat. Some of us are just…

There are screenwriters who are skinny-fat, which is one of my favorite new terms. They’re not probably weight-wise overweight; they just have no muscle tone whatsoever. It’s as if they were sculpted from a goo.

**John:** Mm-hmm.

**Craig:** And it makes sense, because our jobs are completely sedentary. And more than that, I think, they’re very internal. We prize and are rewarded for what goes on in our brain and not at all for what we do with our bodies. Not even one iota. So it’s only natural that taking care of our bodies would drop into second, or third, or fourth place on our list of things to do in a given day.

**John:** As we dig into this, I do want to stress that I understand how strange it seems to be getting advice on being fit from screenwriters. It’s like asking an actor for financial advice.

**Craig:** [laughs]

**John:** But, we’ve both been there. And you were a heavier person.

**Craig:** Yes.

**John:** And I’ve managed to maintain relatively good health throughout my career, but it hasn’t always been easy and it hasn’t always been obvious what the best choices were. So, and I see people making bad choices. I get frustrated when I see people sort of reaching for a magic bullet. Like they’ll focus on one thing, like, “If I stop eating canned foods that will change everything because there’s like a chemical in cans that’s really bad for you so you shouldn’t eat canned foods.”

**Craig:** Oh god.

**John:** It’s like, yeah, you also shouldn’t eat chocolate donuts for breakfast. People who sort of over-fixate on one little thing and don’t look at the big picture of how not to get giant.

**Craig:** That’s a very LA phenomenon. Maybe it’s bigger than this. But I have noticed that there is a bizarre and completely misdirected obsession with food. So, I see people who are not in good shape or who are not taking care of themselves, but they become obsessed with trendy nonsense, gluten and so forth.

I mean, there’s a great article: some people legitimately have an issue with gluten. A lot of people just don’t, but they think they do or they say they do. There becomes an obsession with freshness, you know, organic as opposed to inorganic. I guarantee you if all you did all day was eat the “inorganic,” because all foods organic, but “inorganic” fruits and vegetables and lean meats and proteins you would be in better shape than somebody who ate nothing but pure, organic, gluten-free cupcakes, donuts, bread, cake.

**John:** And a similar situation, too, like vegetarianism or veganism. I was a vegetarian for seven years. I’m not a vegetarian now, but I’m much healthier for not being a vegetarian. And it’s because in fixating on that one thing, like, “Oh, I don’t eat meat, so therefore I can eat everything else,” I made horrible choices. I was eating ice cream rather than chicken, and that was never a good choice.

**Craig:** It’s just not a great idea. And you can be a very smart vegetarian, there’s no question about it. But we’re getting pretty smart. A funny thing happened about ten years, I would say about ten years ago. The diet industry had always concentrated on a certain way of approaching things and then along came this Atkins guy. And, boy, was he beaten up.

But it turns out he was right.

**John:** He was largely right.

**Craig:** He wasn’t completely right in the way maybe he was expressing it. And he got a little cuckoo about it. But the general theory there turned out to be right. So, what we know is in general — I’m not talking even about losing weight. I’m just talking about general, okay, you’re fine, you’re in shape, you’re in a good place. — Generally speaking, eating fewer processed carbohydrates, eating fewer simple carbohydrates, and eating more lean protein, and not being fat-phobic in terms of what you ingest — there are good fats, healthy fats — is a better way to eat than what you and I were taught in the ’70s with the food pyramid, which turns out to just be wrong.

**John:** Yeah.

**Craig:** But that doesn’t help you lose weight.

**John:** For the last 18 months I’ve been doing basically a slow carb diet. I’m a little reluctant to talk about it because it all started with this book I read called The 4-Hour Body by a guy named Tim Ferriss. And Tim Ferriss, he’s, I don’t know, he’s sort of the Ryan Lochte of book writers. And like Ryan Lochte, it’s like, wow Ryan Lochte, you’re a really good swimmer. Congratulations on being a really good swimmer. But I’m not sure I’d want to hang out with him. That’s the same way I kind of feel about Tim Ferriss is that what he’s saying actually works and makes sense, but that doesn’t mean — I’m not vouching for him as like “here is the go to guru that you should trust with everything in your life.”

But the 4-Hour Body, I’ve been on it for 18 months, and it works really, really well. I lost about ten pounds and it’s very easy to maintain. It takes the basic ideas of like an Atkins or a South Beach, which is largely what you’re describing, like you’re cutting out your simple carbohydrates and going for lean proteins. It does that with — it also cuts out dairy and it allows you to sort of have the longer burning carbs like beans so that you actually can stay full.

And it’s been the easiest thing I’ve ever done diet-wise, largely because of one extra exception it makes, is that you have one cheat day a week where you can just blow it out and you can eat anything you possibly would want to eat. And that’s been its savior, because when I’ve done South Beach or other kind of diety things, you just get so angry and crazy and you look at stuff, like I will never be able to eat a brownie again.

And on this it’s like, well, yeah, I can eat a brownie on Saturday. And, in fact, I can eat two brownies on Saturday, but I just won’t eat it the rest of the week. And it’s been a godsend. It’s been really easy. And you don’t have to count calories. You don’t have to worry about anything because you just say, like, “These are the things I can eat. For six days a week these are the things I eat. On the seventh day I rest and I can eat anything.”

**Craig:** Right. Well it’s important for me to point out that there’s two ways of approaching this depending on what group you’re in. If you are somebody that is trying to be more fit but you’re not obese, then I think there are reasonable approaches that are all essentially the same that are going to be good for you: Increasing your exercise level in some way that doesn’t make you crazy; and shifting gradually away from the simple carb/sugary way of eating to a more Atkins/South Beach/Ferriss kind of way, which is complex carbohydrates, proteins.

I mean, dairy for instance is a great thing to limit because, not so much because of the fat in dairy or the protein in dairy but because of the inevitable sugars that come along with dairy. But, that’s for people who aren’t obese.

For people who are obese I think, in my experience, there is a different approach that is required. And the reason why is we now know that fat makes you fatter. How? Fat cells actually release hormones. And the hormones that fat cells release stimulate your appetite and your hunger. You’re already in a bad place because you are likely eating a kind of sugar-heavy diet. And so your insulin levels are getting goofy and your blood sugar is going down which makes you hungry. That’s going on already. But, on top of that, there is this added level of what the fat that you already have accumulated is doing to your brain.

In order to get to a place where you can have some sort of reasonable diet that works, because here you’re saying, “Okay, I’ll lose ten pounds.” There are people who need to lose 100 pounds. There are people who need to lose 200 pounds. What do you do?

You could do Tim Ferriss for 12 years. It’s not going to do it for you. For those people there are basically two options. There’s surgery. Sorry, there’s two options I see as being reasonable.

**John:** All right.

**Craig:** There is surgery. And then there is what they call very low calorie diets, which have been shown to work and, in fact, it’s what I did. And it worked amazingly well. Surgery we all know about. I’m not going to go into it, although I’m not against it. But the very low calorie diet is pretty simple. You’re going to eat something like 850 calories a day, which is not a lot at all. And it is essentially going to comprise nothing more than lean proteins, a very small amount of complex carbohydrate, a very small amount of fruit, and that’s that. And the first week or two is going to be quite miserable. And then your body realizes that it’s got all this fat that it can burn and it burns it amazingly efficiently.

And once your body converts over into this fat-burning mode, because it’s nowhere near the calorie level it needs from food intake, you stop being hungry because you’re essentially eating yourself. And the fat loss is quite rapid. And I will say this: When it comes to losing weight for very heavy people, the only way to really maintain it is to get rid of it completely. Like you’ve got to go all the way. If you’re 300 pounds and you’re 5’11”, you can’t go down to 225 pounds and celebrate. You’re still overweight. The fat is still there playing tricks on your brain.

You’ve got to go down, down to 170, down to 175 or 180, whatever is right for you. And then you can start to…

By the way, at that point then exercise becomes a reality. Don’t tell 300-puond people that they have to go out and exercise. They can’t. You can’t. I mean, what do you weight, 170 pounds?

**John:** Yeah, exactly.

**Craig:** Okay. I’m pretty good at this.

So, if I said to you I need you to go out and exercise but for the next week I need you to strap on 130 pounds, for all of your exercise. Weightlifting, there’s 130 pounds on top of your body. Running, jogging, stretching, yoga, everything — 130 pounds. You wouldn’t last a minute. You can’t say to these people exercise. They can’t. No one can.

I mean, well, some people, like Olympic people. But my point is you’ve got to lose the weight to exercise. So when people say, “Well, you know, this guy needs to do a pushup” — you do a pushup with 130 pounds on top of your back. Good luck.

So, my advice is to think about a very low calorie diet. However, you have to do it under a doctor’s supervision.

**John:** You have to do it under a doctor’s supervision. And you had a doctor supervise when you did this?

**Craig:** Yes. Because it’s a fairly extreme thing to do. And there are some side effects that they know about. They’re certainly not universal. There’s a percentage, there’s an elevated risk of gallstones when you do something like this. And you have to watch your nutrition. You have take vitamins and you have to make sure that you supplement in that regard. And you need somebody taking your blood essentially every couple of weeks to make sure that something isn’t gong incredibly wrong. But, if you are doing this as part of a physician-monitored program, it’s quite extraordinary. What happens to your body on the outside is impressive. What happens on the inside is even more impressive.

Your blood pressure goes down. Your heart rate goes down. Your bad cholesterol goes down. Your good cholesterol goes up. Your triglycerides go down. Your liver enzymes — because a lot of people don’t know that we store fat and glycogen in our livers — your liver enzymes go down.

I mean, you can essentially create the same state in your liver that alcoholics create through overeating. It’s pretty remarkable. And when you look at our country and all the problems we have, health-wise, you can trace almost every single one of them — the chronic, widespread epidemic ones — back to weight.

**John:** You wouldn’t have nearly as many people on CPAP machines if weight was lower.

**Craig:** I mean, you’d have almost no one on CPAP machines. I mean, very few people have congenital throat structural sinus issues that require CPAP machines. Depression. Sleep apnea. Back problems. Joint problems. Anxiety. Sexual dysfunction. I mean, what else? Skin problems. So many of these issues you can track back to just being overweight.

And we, as screenwriters, I think just have to be really aware that our job is sitting and thinking, and that means if you are really overweight it’s time to get extreme about it. And if you’re not really overweight it’s time to exercise.

**John:** Yeah, so let’s talk about exercise because one of the challenges I think as screenwriters is we’re often working alone. If you haven’t exercised before, if you haven’t been to the gym it’s hard to start going to the gym. And that was the problem I really faced when I first moved out to Los Angeles is that I was going to USC and I knew that, okay, I should probably start working out because it’s the kind of thing a person should do when they’re in their early 20’s. But I didn’t sort of know how to do it.

And so fortunately I had friends who did work out. So I first started working out with my friend André Béraud, who worked out at the USC gym. Then I worked out with my friend Tom Hoffman at the YMCA gym on the west side. And that was crucial. I think working out with somebody was hugely helpful to me.

So, I could go to classes and stuff like that, but if you’re actually lifting weights or doing other stuff, having someone there to show up…it’s like having a writing partner. Having someone who you’re responsible for on a social level, showing up and actually doing the work was hugely helpful.

Later on, you know, as I had some money and my schedule got more busy, I had a real trainer. And that’s like kind of a friend you pay. But it was helpful. And because I knew I was paying for those sessions, I would show up and I would do what the trainer said so I would not get fat, or stay in shape.

**Craig:** Yeah, look, there are all sorts of ways to approach exercise. And I’m a very — my attitude is it’s all good. All exercise is good, at any level. Walking up the street for ten minutes is good. I will say that, right now, so I’m doing P90X. And P90X is a fairly intense — it’s a very intense program. I’m early on it. And I almost never get to the end of the session. I just fall apart.

But I know then, okay, that’s good. [laughs] If I’ve gotten to the place where I literally am just gasping…

**John:** You’ve actually done the work.

**Craig:** …and drenched in sweat. And can’t go any further. I’ve done a hell of a job that day. And so I just presume that it’s going to get easier and better, and that’s the key. When we start exercising there’s a tape that runs in our head. “I’m exercising now for the first time because I’m ugly/fat/slow/weak/lazy. I exercise and it hurts, it’s painful. I’m ungainly/awkward/weak/not very good at it/can’t finish it/not like the people on the tape/not like the people next to me in the gym/not like the people on TV.”

Let me feed that loop back into, “I’m no good/I’m lazy/I’m weak/I’m tired,” da, da, da. That’s the part that you’ve got to just sever. Your fine. You’re exercising. Congrats. You’ve already won. Gold star for you.

Yes, of course you’re going to be weak and ungainly and clumsy and in pain for awhile. And then you won’t be. And you will not be able to get to the won’t be until you get through the will be. Just like writing a script. [laughs] You’ve got to look at it that way. “Okay, page one. Big empty script. Oh god, this is gonna suck for awhile.” But you will get to a place where it’s flowing and it’s easy. And exercise leads to more exercise.

**John:** Yeah. And I do feel sometimes people in their diet, they try to take too — either they try to go too far and they try to get on something so crazy that they can’t possibly maintain. I see them doing the same kind of things with exercise. Like they haven’t exercised at all and suddenly they’re like, “I’m going to run ten miles today.” And like, well, that’s not going to work out well for anybody.

**Craig:** That’s right.

**John:** So that is one of the things you can sort of ease your way into. I mean, as far as diet, just start with breakfast. Just don’t eat a terrible breakfast. Don’t eat Eggo Waffles for breakfast. East scrambled eggs and black beans. That’s what I have for breakfast almost every morning. And everyone is like, “God, don’t you get bored of scrambled eggs and black beans?”

Yeah, well kind of. But it’s breakfast. Who cares? You’re going to be eating the same thing for breakfast most days in your life anyway. So rather than cereal you’re eating scrambled eggs and black beans. It’s fine.

If I’m in New York I’ll go to one of the deli places and have them make an egg white omelet with spinach and mushrooms. It’s good. It’s protein. It fills you up. And I don’t get that crazy hunger two hours later. The same thing with exercise. You’re doing the P90X which is awesome. And if you can keep it up for the time that you’re supposed to be doing it, that’s great. But if a person just wants to start like hiking at Runyon Canyon a couple times a week, that’s going to be a much better and more realistic start.

**Craig:** For sure. Yeah. Because I’m already kind of in shape. You know, I’ve been going to a trainer for awhile. I know what it means to work out. I know what it means to do pushups. I know what it means to weight train. But when I first started I was fat and I couldn’t do anything.

And right now where I am, it’s funny, because Todd Phillips did P90X. He’s the one that sort of said, “You should do this.” And he showed me a picture and I was like, “Oh my god,” look, because I’ve known the guy for awhile. And you don’t really see what’s going underneath people’s shirts. And he showed me a picture of what he looked like without his shirt on. I’m like, “Geez, look at that.” It’s amazing actually.

So, I started doing it. And every day I would just send him an email and say, “I can’t believe you did this. I can’t believe you did this for 90 days.” But he did do it for 90 days. And the point is he couldn’t, I mean, when he started he couldn’t believe it either. You just have to — so you’re always, you know, it’s like when we talked about Jiro and sushi. You’re not — oh, god, I can’t believe I don’t remember the name of the guy who just won the Decathlon. He’s the most in shape, fit guy in the world; we’re never going to be that guy. There’s always going to be someone more in shape than you, so relax, and just do what you can do.

**John:** Yeah. Be a better version of who you can be. And I think Todd Phillips is a good example because it’s a guy who doesn’t have to be in great shape. He’s not going to be an athlete. I’m not going to be an athlete. You just want to be in good enough shape so that you’re able to chase your kids around and not be tired walking up a hill.

**Craig:** Eh, he ain’t chasing kids around, but he’s chasing something around. [laughs]

**John:** [laughs] You’re always chasing something. I want to live for a really long time.

**Craig:** Yeah.

**John:** I don’t want to die. I want to live a super, super long time. I’d love to the singularity but if I don’t make it there I want to at least live to grandkids. And so this is helpful ways to get you closer to that.

**Craig:** Well, I’ll tell you, I don’t even want to live a long time. I want to live a normal time. I just want the quality of my life to be awesome while I’m here. And it’s very difficult to have a good quality of life when you’re fat and tired and grumpy and depressed. So, to me it’s all about quality as opposed to quantity.

**John:** Yeah. And one of the things I will stress about sort of the people who go gung-ho into something so hardcore and then — the danger of going so gung-ho into something is that when it doesn’t work, when it fails, you feel like a failure. And it just sets up that whole cycle again. So, making smaller changes that keep stacking up is going to be a better solution for most people.

What you said before about the medical weight loss, that I can see because you have somebody backing you up. You’re on this program. You’re clearly in or you’re out of this program. But for most people I think if you’re trying to lose 10 pounds or 15 pounds that you’ve stacked on in your 30’s, ramping up and sort of changing your life rather than trying to drop them all at once is going to be a better experience.

**Craig:** Totally. Yeah. Completely.

**John:** The last thing I want to get to is really a screenwriter problem, and also an editor problem, too. We are people who sit a tremendous amount of time in chairs looking at screens. And the old advice used to be you need to get a better chair. And I strongly suspect now the better advice is don’t get a better chair, just stand up. I think we’re going to keep getting data that show that sitting in chairs for long periods of time is terrible no matter what else you do.

And so screenwriting is one of those things were like, yes, sometimes you really do have to buckle down and maybe sit down and actually type. But when you’re not actually typing, stand up.

And so like I’m recording this podcast standing up. If you’re taking phone calls stand up. You can also just lean on the kitchen counter and do stuff or stick your laptop on the counter. Try to not be down in that chair so much because I think it slows your body down and it changes how your body works.

I’ve noticed I’ve slept much better since I’ve started standing up.

**Craig:** Yeah. That is good advice. My posture is awful. I do everything wrong in a chair. I slump. I slouch. I curve. And the only thing I can say is then I get up and I walk around and I stretch. But, you know, I should stand more, it’s true.

**John:** And get a dog. That will also help.

**Craig:** Yeah. I have a dog. She’s lovely.

**John:** Yeah, walking dogs is always good. Because it helps you work through second act problems.

**Craig:** Uh, I still maintain that a shower is the best thing you can do.

**John:** Showers are good too.

So, hey, are you ready for some One Cool Things?

**Craig:** Yeah.

**John:** How about I go first, Craig, because I actually know what mine is?

**Craig:** Uh-huh.

**John:** My One Cool Thing this week is the Jambox by Jawbone. And what this is is a really small little Bluetooth speaker. And it actually comes in two sizes. There’s a really small one that’s about the size of, I don’t know, two candy bars. And you can use it for both a speaker and as a speakerphone. I’ve actually never used the speakerphone function, but I find it to be great as travel speakers. And so if I’m in a hotel room in New York City and I want to listen to music, I can play music off my phone and it plays on the Jambox and it sounds actually good.

I used it this last week because I was meeting with a composer and I needed to play a bunch of songs for him. And it’s always like, “Oh, do you play it off your laptop?” It’s like, “No, this actually sounds much better.” So from my phone I can play the songs I wanted to play him and it worked really well.

For the house we ended up getting a bigger one that can plug in or we can sort of stick on the kitchen counter when we want to. And that’s what we listen to podcasts on a lot. And so as you’re cleaning the kitchen you fire it up, you listen to stuff, it sounds really good, and it’s always there when you need it. So I strongly recommend both of these. They’ve worked really great for us.

They’re rechargeable so you don’t have to keep them plugged in. And they’re terrific.

**Craig:** That sounds good. That will be my Cool Thing for the week, also.

**John:** Awesome. We’ll get to share.

**Craig:** I don’t have one.

**John:** Actually, there are two, there’s a bigger and smaller one, so you can pick which one you want to be your Cool Thing.

**Craig:** Bigger! Bigger.

**John:** Bigger. Always better.

And, Craig, I think we are now safely over 100,000, so I think next week will be the big acoustic set.

**Craig:** Yeah. I got new strings on the way. I’m going to restring my guitar so it sounds nice and bright and pleasant. And I’ve got a little thing so I can actually record the vocals and the guitar on two separate tracks into GarageBand so I can make it all nice and pretty.
